Indenture between David MACKEY and Matthew BORLAN (1851)

This Indenture made this twelfth day of April in the year eighteen hundred and 
fifty one between David Mackey of Cecil County in the State of Maryland of the 
one part and Matthew Borlan of the same County and State aforesaid of the other 
part.  Whereas the above named David Mackey has applied by petition in writing 
to one of the Justices of the Orphans Court of Cecil County for the benefit of 
the Act of Assembly passed at November session 1805 entitled an Act for the 
relief of sundry Insolvent Debtors and the several supplements thereto and 
offered to deliver up for the use of his creditors all his property real 
personal and mixed to which he is in any manner entitled and whereas the said 
Justice has appointed the above named Matthew Borlan Trustee for the benefit of 
the creditors of the said David Mackey.  Now This Indenture Witnesseth that the 
said David Mackey in consideration of the premises and the further consideration 
of one dollar to him in hand paid by the said Matthew Borlan before the sealing 
and delivery of these presents the receipt whereof is hereby acknowledged, hath 
granted bargained sold assigned transferred conveyed and confirmed and by these 
presents doth grant bargain sell assign transfer convey and confirm unto the 
said Matthew Borlan his heirs and assigns as Trustee for the benefit of the 
creditors of him the said David Mackey all his the said David Mackey’s property 
real personal and mixed to which he is in any way entitled and all debts claims 
accounts notes bonds and evidences of debt and sums of money due and owing to 
him or to which he may in any manner be entitled.  To Have and To Hold the same 
and every part thereof and all his right title interest and claim in and to the 
same and every parcel thereof both at law and in equity to the said Matthew 
Borlan his heirs successors and assigns in trust for the use of the creditors of 
the said David Mackey and to and for no other use intent or purpose whatsoever.  
In witness whereof the said David Mackey hath hereunto set his hand and seal on 
the day and year first herein before written.

Be it remembered that on this twelfth day of April in the year one thousand 
eight hundred and fifty one before the subscriber one of the Justices of the 
Orphan’s Court of said County personally appears David Mackey who is personally 
known to me to be the same person named and described as and professing to be 
the party grantor in the above and foregoing indenture and acknowledges the said 
indenture or instrument of writing to be his act and deed.  In testimony whereof 
I hereunto subscribe my name on the day and year above written.
