WITNESSETH, that whereas William S Evans is the Assignee of a certain mortgage from Rebecca J Merritt, et al, to Mollie D Arbuckle, dated the 10th day of January, in the year Eighteen hundred and ninety eight, and which is now of record in Liber JGW No 3, Folio 176, one of the Mortgage Record Books for Cecil County aforesaid, and; WHEREAS the said Mollie D Arbuckle or her assigns were authorized and empowered by a clause in said mortgage, to sell the mortgage real estate therein mentioned in case of default being made in any covenant, condition, stipulation or agreement therein contained, and; WHEREAS default was made in the payment of the principal sum or mortgage debt secured by said mortgage as well as the interest accruing thereon and taxes thereon levied and imposed by law, and the said mortgage having been duly assigned to the said William S Evans as would more fully appear by reference thereto. He the said William S Evans the said Assignee as aforesaid after giving bond with security for the faithful performance of his trust, which was duly approved by the Clerk of the Circuit Court for Cecil County, and after complying with all the previous requisites of said mortgage and of law did on or about the 7th day of May, in the year Nineteen hundred and eighteen, sell unto the said Mollie D Arbuckle at public auction the following described real estate and at the price following, that is to say: All those three adjoining lots or parcels of land situate, lying and being in the Town of Elkton, Cecil County aforesaid, two of which are situate on the North side of Back or High Street in said Town and the other on the East side of Milburn Street also in said Town, they being the same lots of land which were conveyed unto the said Rebecca J Merritt by James Clendenin and wife by deed dated the 25th day of October, AD 1886, and is now of record in Liber JAD, No 13, Folio 190, etc, one of the Land Record Books for Cecil County aforesaid, and by a deed from Calvin Merritt to the said Rebecca J Merritt dated the 30th day of November, AD 1886, and which is now of record in Liber JAD No 13, Folio 191, etc, another of said Land Record Books, and also in a deed from the Mutual Building Association of Cecil County to the said Rebecca J Merritt dated the 12th day of December, AD 1885, and is now of record in Liber JTG No11, Folio 303, etc, another of said Land Record Books, to which said deed and the deeds and papers therein referred to, reference is hereby made for a more accurate and particular description of the real estate hereby intended to be conveyed together with the buildings and improvements thereon erected and being, at and for the full and just sum of thirteen hundred and two dollars ($1302.00) current money. AND WHEREAS the aforesaid sale, has been duly reported to and ratified and confirmed by the Circuit Court for Cecil County in Equity in Cause No 3439, Equity Docket “In re the mortgaged real estate of Rebecca J Merritt, et al” and the purchase money as aforesaid having been fully paid and satisfied to the said Assignee he is authorized to execute these presents. NOW THIS DEED WITNESSTH that the said William S Evans Assignee as aforesaid for and in consideration of the premises aforesaid and the further sum of ten dollars ($10.00) current money to him in hand well and truly paid by the said Mollie D Arbuckle at and before the ensealing and delivery of these presents the receipt whereof is hereby acknowledged, has granted and by these presents does grant unto the said Mollie D Arbuckle all of the real estate herein mentioned and described as having been sold unto the said Mollie D Arbuckle together with its appurtenances and all the right, title, claim, interest and demand of the parties to the aforesaid mortgage and every of them both at law and in equity, in and to the same and every part and parcel thereof. TO HAVE AND TO HOLD the aforesaid tracts, parts of tracts, or parcels of land and premises together with their appurtenances unto the said Mollie D Arbuckle forever in fee simple. IN TESTIMONY WHEREOF the said William S Evans, Assignee, has hereto set his hand and seal the day and year first herein written.
