Mortgage between David H & Alvina J COLLINS and Mary L BIDDLE (1858)

Cecil County Land Record Book, Liber WHR, Number 1, Folio 249

This Mortgage Made this Seventeenth day of April in the year Eighteen hundred 
and fifty Eight, by David H Collins and Alvina J Collins his Wife.  Witnesseth, 
that in Consideration of the sum of Eight Hundred dollars, With interest thereon 
from the Twenty fifth day of March in the year Eighteen hundred and fifty Eight, 
Now due from the said David H Collins to Mary L Biddle of Cecil County in the 
State of Maryland they the said David H Collins and Alvina J Collins his Wife do 
grant unto the said Mary L Biddle in fee Simple, All that tract, part of a 
Tract, piece or parcel of land, Situate lying and being in Cecil County 
Maryland.  Beginning for the outlines thereof at a Stone planted in the ground 
at Fair Hill Cross Roads, being the beginning place of four Tracts of Land, and 
running thence South Eighty six and one quarter degrees West, seventy six 
perches, thence North Ten degrees West one hundred and sixteen perches, thence 
North fifty five degrees forty minutes East Seventy two and four tenths perches 
to a stone at Sharp’s Grave Yard, thence by the Road to the place of beginning.  
Estimated to contain Sixty Acres of land More or less, this having the same Real 
Estate Which Was Conveyed on the Seventeenth day of April Eighteen hundred and 
fifty Eight by David H Sutton and Julia Sutton Executors of Thomas P Sutton 
deceased and Elizabeth Sutton and Loir[?] Hall & wife to the above named David H 
Collins, to which said Deed when recorded among the Land Records of Cecil County 
for a fuller description of Said Real Estate reference is hereby made:  Provided 
that if the said David H Collins shall pay on or before the twenty fifth day of 
March Eighteen hundred and fifty nine to the said Mary L Biddle the sum of Eight 
hundred dollars with interest thereon from the Twenty fifth day of March 
Eighteen hundred and fifty Eight (the said Interest to be paid Semi-annually) 
according to the terms of his Bond of Even date herewith, then this Mortgage 
shall be void.  And the said David H Collins Covenants that he will pay to the 
aforesaid Mary L Biddle the said sum of Eight hundred dollars, With interest 
thereon as aforesaid, the said interest to be said Semi-annually.  And he 
further Covenants that in default of payment the said Mary L Biddle May Enter.
