The bill states that on the 21st day of February in the year 1826 James Steel the paternal grandfather of the complainant Elizabeth duly made and executed his last will and testament in manner and form sufficient to pass real estate and that during the year 1838 the said James Steel departed this life seized and possessed of considerable real estate which passed by the devises contained in the last will and testament. That the James Steel left the following children to wit: Joseph who is since deceased intestate and without issue, William who is since deceased intestate and leaving the following children his heirs at law viz: James, William, Alexander, Samuel and Telitha all of whom are of full ages and reside in Chester Co. Pa. Mary who is intermarried with James Hill and both of whom are since dead intestate and without issue. Samuel who is since dead intestate and leaving the complainants and Samuel Steel, Joseph Steel, James Steel and Jane Steel who intermarried with one Richard Hall his heirs at law. Sarah who intermarried with one Joseph Paxton residing in Lancaster Co. Pa. David Steel, James Steel, Alexander Steel and Elizabeth Steel all of whom reside in Cecil County. That by the last will and testament of the said James Steel deceased he devised in fee the real estate whereof he died seized consisting of a farm containg about two hundred acres of land in three parts as follows viz: His mansion house with the middle division and part of said farm to his sons Joseph Steel and David Steel, the north part of said farm to his son Samuel Steel and the south part of said farm to his son Alexander Steel and that upon the decease of the said testator James Steel the devisees Samuel Steel and Alexander Steel entered into possession of their said respective portions of the said farm and the said Joseph Steel and David Steel jointly entered upon and continued to hold and occupy thier portion of said farm that the said Joseph Steel having died seized of his moiety of the said farm without issue and intestate the same descended to his brothers James, Alexander, David, his sisters Elizabeth and Sarah and the children of his deceased brothers William and Samuel as his heirs at law. That James Steel the brother of the complainant Elizabrth in the year 1846 departed this life intestate and without issue. That the said Joseph Steel another brother of the complainant Elizabeth departed this life intestate in the year 1848 also departed this life intestate and without issue and that Jane Hall the sister or the complainant, Elizabeth, departed this life intestate in the year 1848 leaving her heirs at law her husband Richard, and five children to wit: Richard, Ann, Elizabeth, Samuel, Joseph, and Issac Hall all residing in Chester Co. Pa and that all the dsiad Children are infants under the age of twenty years. The bill further states that the estate thus left by the said Joseph Steel being a moiety of the middle division of said farm and the estate thus left by the said Samuel Steel being the north part of the said farm is not capable of division among the said heirs and that the said complainants are entitled to an interest in said estates, and that it will be for the advantage of all parties interested in said real estate if the same be sold and the proceeds of such sale divided amongst the parties entitled, according to their several just proportions and that the said James Steel and Samuel, two of the brothers of the complainant, Elizabeth and sons of the said Samuel Steel sold to one John T Moody of Cecil Co all their interest in their fathers part of said farm, but that no conveyance has been made for same. It is thereupon adjudged and ordered that the complainant by causing a copy of this order to be inserted in some newspaper published in Cecil County once a week for one month before the 10th day of November next, give notice to the said absent defendants of the object and substance of this bill and warn them to appear in this Court in person or by solicitor on or before the 15th day of February next to answer the premises and show cause if any they have, why a decree ought not to pass as prayed. Additional Comments: TRUSTEES SALE By virture of two decrees of the Chancery Court of Maryland one of said decrees passed in a cause in said Court wherein James Armstrong is complainant and David Steel defendant and the other in a cause in said Court wherein William Leonard and Elizabeth his wife are complainants and James Steel and others are defendants the undersigned as Trustee will offer at public auction.
