The submitter has given permission to the USGenWeb Archives to store the file permanently for free access. http://www.usgwarchives.net ****************************************************************************** N: 65 George Churchman I George Churchman of East Nottingham in Cecil County, Maryland, considering the frailty and mortality of my body, I have been disposed deliberately to settle my outward affairs by Will and by certain Deeds and instruments of writing, signed and executed prior to the date hereof; for altho through the blessing of Divine Providence I am favored with a good degree of health, a change may soon take place and I be removed to another state of being. First my will is that my body be decently buried in a plain way consistent with the frugality and moderation which have been observed heretofore in the interments of my parents a their request; (as it accords with real Christianity, and with my religious profession that superfluity be avoided:) and that my just debts, as well as the charges attending my funeral may be paid as quickly after my decease as time and circumstances may allow of-----------having already disposed of a considerable part of my Estate or property to my children according to what I supposed to be equity considering past and present circumstances; as will appear in and by divers Deeds and instruments of writing which were signed and executed on the 22nd day of the third month in the present year; also drawn up and left in writing a Schedule with an account of the reasons or moving causes for my so doing; which is meant to explain the principles which governed in forming this my Will, and direct and do request that the same account may by my Executors be carefully preserved for the perusal and information of my children and their heirs______ hereafter. First, I give and bequeath to my eldest surviving son, Mordecai Churchman the sum of one hundred dollars for his own use and disposal; to be paid by my Executor as soon as may be convenient after my decease. 2ndly, I give and bequeath to my son, Edward Churchman the sum of one dollar besides what he has received as stated in an Instrument of writing forein before mentioned. 3rdly, I give and bequeath to my daughter, Margaret Churchman the sum of one dollar besides what is already secured to her in another way. 4thly, I give and bequeath to my daughter, Gainor Churchman the sum of one hundred and ten dollars in addition to what articles she has already received (tho the value hath not been large) to the use of her, her heirs, etc. to be paid by my Executors hereafter named as soon as is convenient after my decease. 5thly, I give and bequeath to my son, George Churchman, junior the sum of one dollar besides what he has already received of my Estate as mentioned in the Schedule and account aforesaid. 6thly, I give and bequeath to my son, Joseph Churchman the sum of one dollar besides what he also has already received as mentioned in the same account. 7thly, I give and bequeath to my daughter, Hannah Churchman the sum of one dollar besides what is already secured to her. 8thly, I have proposed to leave with my Children a list or catalogue of my books and manuscripts with written instructions concerning the manner in which I desire and direct them to be divided, not doubting that they will comply therewith, and be satisfied. 9thly, And whereas there is a lot or parcel of ground call the School Land containing sixty acres with two buildings on the same adjoining northward of the Lands which have been in my possession; which Lot was heretofore sold and intended to be conveyed by me to certain Trustees for the purpose of providing for the schooling of poor children of certain descriptions; For the conveyance of which Lot of land, a Deed or instrument of writing was formerly signed and an obligation given by which I stand bound to complete the title or to direct that it shall be completed: It having been concluded and directed by those concerned in the business that the said Lot of ground with the buildings thereon and other appurtenances be sold as soon as conveniently can be and the produce of the Sale thereof be secured, appropriated and applied here after to a like purpose else where at some suitable time. Therefore as the title to that lot of land has not hitherto been fully confirmed by me; if it should not happen to be disposed of in my lifetime, as be confirmed by a proper deed to the person who may purchase the same and be executed by myself; In order that what is just and right touching the premises may be fully complied with. It is my Will and I do hereby direct, authorize and appoint my Executors to make such conveyances (or the survivors of them) for vesting in the purchaser or purchasers of the said School Lot in absolute right in and to the same according to all proper metes and bounds, as for the title is vested in me, and I do hereby ratify the act of my said Executors or the survivor of them, respecting this business on my behalf, declaring that their conveyance of three premises shall be as valid to all intents and purposes as if performed by myself to the person or persons that may purchase the said School Lot of ground and its appurtenances. 10thly, My will is and I do hereby direct that all the -------------- or residue of my property and estate, whatever it may be or where ever to be found, Real or Personal, shall be (or the value thereof) equally divided among my Children or their heirs, namely the seven legatees therein before mentioned and I do give and bequeath to each of them respectively a full equal share of such residue, if there be an found after my decease. Lastly, I do nominate and appoint my beloved sons George Churchman junior and Joseph Churchman my Executors to this my Will: hereby revoking every other Will or instruments of this kind and fully confirming this only to be my last Will and Testament.
