The submitter has given permission to the USGenWeb Archives to store the file permanently for free access. http://www.usgwarchives.net *********************************************************************** Jacob Egner In the name of God Amen I Jacob Egner of Cecil County in the State of Maryland being sick and weak in body but of sound and disposing mind memory and understanding considering the certainty of death and the uncertainty of the time thereof and being desirous to settle my worldly affairs and thereby be the better prepared to leave this world when it shall please God to call me hence do therefore make and publish this my last will and testament in manner and form following that is to say First and principally I commit my Soul into the hands of Almighty God and my body to the Earth to be decently buried at the discretion of my Executor herein after named and after my debts and funeral charges are paid I devise as follows Item 1st I give and bequeath to my son Joel E Egner my negro boy John who is to serve intill(sic) he is twenty eight years of age and also to my said son Joel my large family Bible 2nd I give and bequeath unto my daughter Elizabeth Fifty Dollars to be paid her by my Executor twelve months after my decease which fifty Dollars is all I intend her to receive out of my estate 3rd I will and bequeath to my beloved wife Margaret Egner one third of all my real and personal estate after the payment of the aforesaid Legacies and all my just debts and the balance of my estate to be equally divided among my six children namely Mary Joel Margaret John David and Harriet share and share alike And lastly I do herby constitute and appoint my trusty friend Edward Wilson of Elkton to be my whole & sole Executor of this my last will and testament, revoking and annulling all former wills satisfying and confirming this to be my last will and Testament. In testimony whereof I have hereunto set my hand and affixed my seal this twenty third day of June in the year of Our Lord Eighteen hundred and twenty eight Jacob Egner Signed sealed published and declared by Jacob Egner the above named testator as for his last will and testament in the presence of us who at his request in his presence and in the presence of each other have subscribed our names as witnesses thereto A F Henderson John Gooding Andrew McIntire Cecil County July 3rd 1828. Now came Edward Wilson, the Executor named in the aforegoing Instrument of writing and made Oath upon the Holy Evangely of Almighty God that the aforegoing is the true and whole last will and testament of Jacob Egner the testator herein named which had come to his possession or knowledge. Test Henry D Miller, Reg Cecil County Sc July 3rd 1828 Then came Andrew F Henderson and Andrew McIntire two of the subscribing witnesses to the aforegoing last will and testament of Jacob Egner late of said county deceased and severally made oath upon the Holy Evangely of Almighty God that they did see the said Testator sign and seal the same will that they heard him publish pronounce and declare the same as and for his last will and Testament and at the time of his so doing he was to the best of their Knowledge and belief of a sound and disposing mind memory and understanding and that they and John Gooding the other subscribing witness to the same will and subscribed their names as witnesses to the same will in the presence and at the request of the said Testator and in the presence of each other.
