These electronic pages may NOT be reproduced in any format for profit or presentation by other organizations. _________________________________________________________________________ May 24, 1729 - Charles Co., MD Will book Liber CC#2 Folio 725-726 Last Will and Testament of Oliver Burch (father of Ann Burch) In the name of God Amen, I Oliver Burch of King and Queen Parish in Charles County being in perfect health& of sound mind and memory blessed be God for the same and calling to mind the uncertainty of this world that there is nothing certain but death and that most uncertain, when do make and ordain this my Last Will and Testament in a manner and form following (Viz) ---- Imprimis: I give and bequeath my soul into the hands of Almighty God that gaveth me- Doubting nothing but that through the merits and intercession of my Blessed Savior and Redeemer Jesus Christ I shall receive it again at the last day with a full pardon of all my sins my body to the Earth to be buried in a Christian like manner at the appointment of Executors hereafter by me named and as for the worldly goods that it hath pleased God of his goodness to endow me with all, I bestow in manner and form the following ~ viz. ~ Item: I give and bequeath to my son Benjamin Burch Seventy Five acres of land it being part of a tract of land called, Bowlings Plains to him and his heirs forever. Item: I give and bequeath to my two sons Thomas and John Burch five shilling sterling a piece. Item: I give and bequeath to my son Edward Burch one feather bed and covering, I give the said goods to my son Edward Burch. Item: I give and bequeath to my son Jonathan Burch the two tracts land the one called Lumley and Penrick, I give to the said land to my son Jonathan to him and his heirs forever. Item: I give and bequeath to my daughter Katherine Swann five shilling sterling. Item: I give and bequeath to my daughter Anne Swann five shilling sterling. Item: I give and bequeath to my daughter Barbary Allison five shilling sterling. Item: I give and bequeath to my son Justinian Burch five shilling sterling. Item: I give and bequeath to my daughter Elinor Burch five shilling sterling. Item: I give and bequeath to my daughter Elizabeth Cade five shilling sterling. Item: I give and bequeath to my beloved wife Barbary Burch the plantation whereon I now live with all the Land there unto belonging during her natural life and after to fall to my son Jonathan and his heirs for ever I nominate and appoint my well beloved wife Barbara Burch whole and sole executrix of this my Last Will and Testament revoking all other wills or will by me formerly made ratifying and confirming this and none other to be my last will and testament. In Witness where of I have hereunto set my hand and seal this 15 day of February 1726 ~ Oliver Burch Signed sealed and delivered In presence of ~ ~ ~ At the post of the aforegoing Will was thus written (viz) Geo. Brett May 24th 1729 then came George Brett and made Oath on the holy Evangelist that he saw the James Phillips above named Oliver Burch sign and seal the above and heard him publish and declare the same to Anne O. Phillips be his Last Will and Testament and that at the time of his so doing he was of sound and perfect memory to the best of his Judgement and that no other no other sponsor was called at that time as a witness on subscribed as such . Sworn before me ~ J. Hanson D. Combs James Phillips being present when the above probate was made & declared that the above Will was brought to him some time after it was signed and he and his wife were desired to subscribe the same as witnesses which they did but not in the presence of the Testator not at his request neither did he the Said James ever hear him mention anything concerning said will either before or after. Combs __________________________________________________________________________ June 1, 1743- Charles Co., MD Will book Liber DD#2 Folio 99-100 Last Will and Testament of Samuel Swann (father of Samuel Swann) MacGruders Vol 23, page 136 In the Name of God Amen, I Samuel Swann of Charles County being very sick and weak in body but of perfect sense and memory / thanks be to Almighty God for the same/ Calling to mind the uncertainty of this Life and knowing that it is appropriate for all men, once to die do make and ordain this my Last Will and Testament in manner and form following~ Imprimis. I give and bequeath my soul into the hands of God that gave it me hoping through the mercies and merits of Jesus Christ my blessed Savior and Redeemer to obtain Joyful Resurrection the Last Day. Item. I give and Bequeath my Body to the Earth to be buried in a decent and Christian Manner according to the discretion of my Executor and for what Worldly goods it has pleased Almighty God bless me with, I give and dispose of in manner and form following~ Item. I give and bequeath unto my well beloved son Edward Swann eighty acres of land being part of a tract of Land called Egleton and lying on the south side of the Mill Branch being my now dwelling plantation to be possessed and enjoyed by him the said Edward Swann and his heirs forever after the decease of my well beloved wife Ann Swann. ~ Item. I give and bequeath unto my well beloved son Samuel Swann one feather bed and covering.~ Item. I give and bequeath unto my well beloved son Mercer Swann one feather bed and covering.~ Item. I give and bequeath unto my well beloved son Burch Swann one shilling and no more.~ Item. I give and bequeath unto my well beloved daughter Susannah Wheeler one shilling and no more.~ Item. I give and bequeath unto my well beloved daughter Elizabeth Wheeler one shilling and no more.~ Item. I give and bequeath unto my well beloved daughter Barbara Muggleston one shilling and no more.~ Item. I give and bequeath unto my well beloved daughter Sarah Dyer a guide cow big with calfs and no more.~ Item. I give and bequeath unto my well beloved son Edward Swann one red heifer big with calfs and no more.~and all my personal estate. Item. I hereby nominate constitute appoint and ordain my well beloved wife Anne Swann and my son Edward Swann as Executors of this my Last Will and Testament hereby utterly revoking and disannulling any other will or wills by me formerly made or done and acknowledging this and no other to be my Last Will and Testament. In Testimony where of I have here unto set my hand and my seal this 17th day of April Anno Dom 1743. On the 1st day of June 1743, came Samuel Amery - Benjamin Thorne and Benjamin King subscribing witnesses to the above will and made oath on the holy Evangelists that they said Samuel Swann the Testator signed the same and heard him publish and declare to be his Last Will and Testament and that at the Time of his so doing he was of sound and disposing mind and memory to the best of their apprehensions and that severally subscribed their names thereto as witnesses in the presence of the Testator and at his request.
