The submitter has given permission to the USGenWeb Archives to store the file permanently for free access. http://www.usgwarchives.net *********************************************************************** Eleanor Canter Will Written October 17th 1822 in Charles County, Maryland In the name of God Amen, I Eleanor Canter of Charles County State of Maryland being very weak in body but of perfect mind and memory thanks given unto God, calling unto mind the mortality of my body and knowing that it is appointed for all men once to die do make and ordain this my Last Will and Testament that is to say principally and first of all I give and recommend my soul unto the hands of almighty God that gave it and my body I recommend to the earth to be buried in a decent and Christian burial at the discretion of my friends nothing doubting but at the general resurrection I shall receive the same again by the mighty power of God and as touching such worldly Estate wherewith it has pleased God to bless me in this life, I give devise and dispose of the same in the following manner - First I give and bequeath unto my daughter Elizabeth Canter's seven children namely Mary Canter, Lettice Canter, Catharine Canter Eliza Harriet Canter, John Alexander Canter, Robert Canter, Ann Morris Canter one Negro woman called Paicey, also one Negro boy called named Henry to be equally divided between them - I give and bequeath unto my grand daughter Mary Canter one dark gray colt. I give and bequeath unto my son Robert Lyon one Negro man called Daniel also one Negro girl called Charity. I give and bequeath unto my son Horatio Canter one Negro girl called Vine, one light gray mare, also one gray horse, one yoke of steers and yoke of steers and yoke one Ox cart, one bundle cow, also all my plantation utensils, one new bed and furniture, one oval table and table cloth, one large iron pot, one small stone pot, also the present or last crop of corn, fodder, rye oats and tobacco and five hundred weight of pork. I give and bequeath unto my two sons Robert Lyon and Horatio Canter a tract of land purchased by me of Elijah Canter lying on the left side of the road leading to Bryantown to be equally divided between them after their paying sixty dollars to each of my three children namely Elizabeth Canter, Lydia Musgrove Moran and Henry Canter. After my burial expenses and all my just debts are paid, I give and bequeath unto my five children namely Elizabeth Canter, Robert Lyon, Lydia Musgrove Moran, Henry Canter and Horatio Canter all other property that I possess also all money on hand and all money's due me to be equally divided between them as whereunto I have signed sealed and delivered in presents of this seventeenth day of October one thousand eight hundred and twenty-two. November 13th 1822, Then came Erasmus Gill and Samuel Cartwright two of the subscribing witnesses to the a foregoing Last Will and Testament of Eleanor Canter late of Charles County deceased and severally made oath on the Holy Evangels of Almighty God that they did see the Testatrix wherein named sign and seal this Will and that they heard her publish, pronounce and declare the same to be her Last Will, that at the time of her so doing she was to the best of their apprehensions of sound and disposing mind, memory and understanding and that they together with Gustav Gill the other subscribing witness respectively subscribed their names as witnesses to this Will in the presence and at the request of the Testatrix and in the presence of each other. Of money paid this accountant it being a balance due him in right of his wife Elizabeth from the Estate of her father Joseph Lyon, whose relict administered on the Estate of the said Joseph Lyon deceased and afterwards intermarried with Leonard Canter deceased during the minory of the children of said Lyon (Elizabeth and Robert) and for which the deceaseds Estate was liable. Of money paid Robert Lyon it being his distribution share of the Estate of his father Joseph Lyon and for which the deseaseds Estate was liable. James Canter -- Sureties Zachariah Johnson - Representatives; The widow and 5 children of the deceased namely Lydia Canter, Ann Canter, Henry Canter, Levin Canter and Horatio Canter - On the back of the written account is this written - Charles County Sct. August 14th 1805 Then came James Canter the accountant within mentioned and made oath on the Holy Evangels of Almighty God that the above and a foregoing account as it stands stated is just and true and that he hath actually and bond fide paid or secured to be paid the particular sums for which he claims an allowance which thereupon after due examination of the vouchers is passed.
