I Give and Bequeath unto my Son David Oden my Son and to Pembrook Oden all my Real and Personal Estate after that my Debts is all Paid the Plantation slaves to David Oden my son and that David Oden Pay unto my son Pembroke three Thousand Pounds of Tobacco being half the Price of ye Negros and then my son David to keep the said Negros---- Item. I give unto my son Lewis Oden one young Stear and two Pewter Plates---- Item. I give unto my son Thomas Oden one young stear and two Pewter Plates---- As Wittness my Hand this day and year of our Lord one Thousand seven Hundred forty Nine Aprill the twenty fourth---- Item. I give to my Daughter Elizabeth Smith one Great Bason Elizabeth (her O mark) Oden {seal} Teste----Signed Sealed in ye Presence of us---- Thomas Farrand Harnon (his H mark) Churchyard On the Back of the foregoing will was thus Written Viz. Charles County sst: On the 3d day April 1749 came Thomas Farrand and Harman Churchyard Subscribing Witnesses to the foregoing will who being duly and Solemmly Sworn on the Holy Evangelist of Almighty God do depose and say that they saw the Testator Elizabeth Oden Sign and Seale her then Will and heard her Publish and declare the same to be her last Will and Testament and that at the Time of her so doing she was to the best of their apprehension of sound and disposing mind and memory and that they subscribed their names as Witnesses thereto In the Presence of the Testator and at her Request Which Probat was taken in the Presence of David Oden Heir at Law who did not Object thereto---- 3 ½ Sides---- Sworn before Walker Hanson D Comy: Note: This was transcribed from a microfilm copy of the recorded document. There is a discrepency in the dates. The will says it was signed on 24 April 1749, and at the bottom, it says the will was proved "the 3d day April 1749."
