All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/md/mdfiles.htm ************************************************ April Term 1906 Attaway Oliver, Last Will and Testament I, Attaway Henrietta Oliver, of Charles County, in the State of Maryland, being of sound and disposing mind, and understanding and realizing the certainty of death, as well as the uncertainty of the time thereof, do make and publish this, my last will and testament, in manner following, that is to say: Item 1. After the payment of all of my just debts including my funeral expenses, I give, devise and bequeath to and unto Emily Oliver and Ara Oliver, daughters of G. Cornelius Oliver, of Charles County aforesaid, the sum of fifty dollars ($50.00) each, said sum of fifty dollars to be paid to each of them by my executor hereinafter named, free and clear of all and any collateral inheritance tax thereon, said collateral inheritance tax to be paid out of my general estate, by my executor hereinafter named. Item 2. All the rest and residence of my estate, real, personal and mixed, and wherever situate or located, subject nevertheless of the charge hereby made, I give, devise and bequeath to and unto my nephew, Albert E. Willett, of said Charles County, subject nevertheless to the condition and charge that the said Albert E. Willett shall, and will, during the term of the natural life of my husband, Gwinn P. Oliver, of Charles County, aforesaid, comfortably maintain, clothe, and generally support and care for my said husband, Gwinn P. Oliver, in manner appropriate to his station in life. It being my intent to devise and bequeath hereby, that my said nephew, Albert E. Willett, shall possess and manage all of my property, not hereinbefore bequeathed, from the date of my death, subject to administration thereon, but, nevertheless, charged with a proper, competent and comfortable part of my said husband, Gwinn P. Oliver, and during the full term of his natural life and that upon the death of the said Gwinn P. Oliver, and if payment by the said Albert E. Willett, if all the expenses incident to support and maintenance of the said Gwinn P. Oliver, all funeral expenses of the said Gwinn P. Oliver, the real estate included in, and entrusted (?) by "Item 2" of this, my last will and testament, shall be vested (?) in the said Albert E. Willet, his heirs and assigns, free of any charge whatever, in fee simple. All the personal and mixed estate included in and embraced by said "Item 2" of this, my last will and testament, shall rest in the said Albert E. Willett, his personal representatives and assigns, free of any charge, whatever, absolutely. Item 3. In the nature of a request, and not as a charge against the real and personal property hereby devised and bequeathed my said nephew, Albert E. Willett, I ask that, during his lifetime, he personally care for the lot in the cemetery at St. Joseph's Church, Pomfret, wherein my dear(?) is buried, and wherein my said husband is like to be buried, and also that he personally care for the lot wherein my remains may be interred, as he may deem expedient, and as may be convenient to him. Lastly, I constitute and appoint Walter J. Mitchell, of Charles County, in the State of Maryland, aforesaid, to be the executor of this my last will and testament, hereby revoking all other wills and codicils by me heretofore made. In testimony whereof I hereunto subscribe my name and affix my seal this twenty-first day of March, in the year of Our Lord, one thousand nine hundred and six.
