All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/md/mdfiles.htm ************************************************ December Term 1860 Will of James Oliver, Charles County, Maryland (JS 17 276) (MSA microfilm roll CR 80) I will and bequeath as follows: Item 1st, I give and bequeath unto my son, Philip Gwinn Oliver, the sum of four hundred dollars, and choice of the horses I have at my death, one feather bed and furniture, and that he hath the benefit of all my estate for one year after my death, he paying out of the crop that may be made that year, the rent of the farm and such necessary expenses as may be required in conducting the farm, all the crop after paying the rent and necessary farm expenses to be his, to him and his heirs forever. Provided that during that year, he shall take care of my daughter, Margaret Oliver, and my granddaughters, Jane F. D. Curry and Ann C. Curry, provided they or either of them is single and ...then a home, but if either one be married the obligation is released to that one. Item 2nd, I give unto my daughter, Matilda R. Robey, wife of John E. Robey, the sum of one hundred dollars to her and her heirs forever. Item 3rd, I give unto my afflicted daughter, Margaret Oliver, one feather bed and furniture. Item 4th, I give unto my two granddaughters Jane F. D. Curry and Ann C. Curry one feather bed and furniture to them and their heirs forever. Item 5th, I give unto my granddaughter Mary I. Nalley the sum of fifty dollars provided she demand it of either my executor or executrix, within twelve after the recording of my will, otherwise it becomes a part of the residence of my estate and to be disposed of as hereafter named. Item 6th, I give unto my grandchild, Georgianna Oliver, the daughter of my deceased son Luke H. Oliver, the sum of fifty dollars to her and her heirs forever. Item 7th, I give unto my grandson, Luke William Oliver, the son of my deceased son Luke H. Oliver, the sum of fifty dollars to him and his heirs forever. Item 8th, I give unto my daughter, Symfonia A. Curry, wife of Robert S. Curry, the sum of one dollar. Item 9th, I give unto the children of my son Robert Oliver all my right, with interest or claim, in and to the house and lot on which my son Robert now lives, my said son Robert to have a house there as long as he lives, to them and their heirs forever. Item 10th (9th repeated in will), It is my will and desire that my son Robert Oliver, my son Dominic Stanton Oliver each pay to my executor and executrix or either of them the sum of fifty dollars each, and that my granddaughter, Mary V. Lacey, or her guardian, pay the sum of fifty dollars to my executor and executrix or either of them, and that the said sums thus named, together with the residence of my property, after paying my debts and the legacies mentioned in this my last will, my executors first having had a sale of all my property not disposed of by bequest, and after all expenses be paid, then the residence be equally divided as follows: to my son Robert Oliver, one seventh, to my daughter Matilda R. Robey, one seventh, to my son Dominic Stanton Oliver, one seventh, to my son Philip Gwinn Oliver, one seventh, to my afflicted daughter Margaret Oliver, one seventh, to my four granddaughters, Ellen F. Shannon wife of Richard Shannon, Philomela Victoria Shannon wife of George B. Shannon, Jane F. D. Curry & Ann C. Curry, one seventh to be equally divided between them, & to my granddaughter Mary V. Lacey or her guardian, one seventh, the interest of which is to be paid yearly for her benefit & if she dies before coming to age, the principal to be equally divided between my sons Robert Oliver, Dominic Stanton Oliver, Philip Gwinn Oliver & my daughters Margaret Oliver & Matilda R. Robey, each one sixth & the other sixth to my four granddaughters - Ellen F. Shannon, Philomela V. Shannon, Jane F. D. Curry & Ann Curry. Item 11th, It is my will & desire that my son Gwinn P. Oliver & my daughter Matilda R. Robey take care of my afflicted daughter Margaret Oliver as long as she lives & that at her death they receive what has been left her by me as compensation for their trouble. Item 12th, I give the sum of fifteen dollars to whoever may be officiating in the Newport Catholic Church at my death. And lastly I do constitute & appoint my son Philip Gwinn Oliver and my daughter Matilda R. Robey executor and executrix of this my last will and testament, revoking and annulling all former wills by me made and acknowledging this and only this as witness hereof.
