Will of William A. Lyon of Trinity Church, Newport. April Term 1887 Wm. A. Lyon Will In the name of God! Amen! I, William A. Lyon of Charles County in the State of Maryland being sick and weak in body, but of sound and disposing mind, memory and understanding, considering the certainty of death and the uncertainty of time thereof, and being desirous to settle my worldly affairs and thereby be the better prepared to leave this world when it shall please God to call me hence, do therefore make and publish this my last Will and Testament, in manner and form following, that is to say: First and principally, I constitute my soul into the hands of Almighty God, and my body to the earth to be decently buried at the discretion of my Executors hereinafter named. After my debts and funeral charges are paid I devise and bequeath as follows: Having already given my children by my first wife what they are justly entitled to, and wishing to provide for the children of my second marriage, so as to make them equal with those of my first marriage, I will and devise as follows: I give and bequeath all my personal estate of every kind and description unto my seven youngest children, viz: Alexander M. Lyon, Samuel M. Lyon, Stouten W. D. Lyon, Henry H. Lyon, Julia S. Lyon, William A. Lyon and Kate Emma Lyon to be divided among them in equal portions share and share alike. I give and devise all the Real Estate of which I may die seized and possessed to be equally divided between my seven children aforesaid, viz: Alexander M. Lyon, Samuel M. Lyon, Stouten W. D. Lyon, Henry H. Lyon, Julia S. Lyon, William A. Lyon and Kate Emma Lyon in equal portions share and share alike, as hereinafter specified: It is my will and desire and I so direct, that from(?) and after my death, all my Real Estateaforesaid shall be rented out by my Executors hereinafter named, at an appraised valuation, until my youngest child arrives at the age of twenty one years and that the annual rents and profits arising from said Real Estate--after deducting the taxes on the same and the necessary repair bills shall be equally divided between my seven children aforesaid, share and share alike. It is my will and desire and I so direct that no portion of my real estate shall be sold until my youngest child arrives at the age of twenty one years, and then it is my will and desire and I so request, that my seven children aforesaid, viz: Alexander M. Lyon, Samuel M. Lyon, Stouten W. D. Lyon, Henry H. Lyon, Julia S. Lyon, William A. Lyon, and Kate Emma Lyon shall divide the whole of said Real Estate among themselves, according to their respective interests, but in the event that they cannot make an equal and just division among themselves--then I will and direct that all my Real Estate shall be sold by my executors hereinafter named and that the proceeds of sale, after deducting the necessary expenses, shall be equally divided among my seven children aforesaid share and share alike. I do hereby constitute and appoint my sons Philip A. Lyon and Alexander M. Lyon to be quardians to my children, viz: --Samuel M. Lyon, Stouten W. D. Lyon, Henry H. Lyon, Julia S. Lyon, William A. Lyon and Kate Emma Lyon, all of them now under the age of Twenty one years. And lastly, I do hereby constitute and appoint my said sons, Philip A. Lyon and Alexander M. Lyon, to be the executors of this my last will and testament, revoking and anulling all former wills by me heretofore made, notifying and confirming this and none other to be my last will and testament. Ching two of the subscribing witnessess to the last will and testament of W. A. Lyon late of Charles County deceased, and made oath on the Holy Evangely of Almighty God, that they saw the testator therein named sign and seal this will and that they heard him publish, pronounce, and declared the same to be his last will and testament, and that at the time of his so doing he was to the best of their apprehension of sound and disposing mind, memory, and understanding, and that they together with Wm. E. Simpson the other subscribing witness respectively subscribed their names as witnesses thereto in the presence and at the request of the testator and in the presence of each other. Test:--J. Benj.
