Acton In the name of God, herein - I William R. Acton of Charles County, State of Maryland, being in health of body and sound and disposing mind, memory and understanding, considering the certainty of death and the uncertainty of the time thereof and being desirous of settling my worldly affairs and thereby be the better prepared to leave this world when it shall please God to call me hence do therefore make and publish this my last will and testament in manner and form following - that is to say - First I commit my soul into the hand of Almighty God and my body to the earth to be decently buried at the discretion of my Executor herein after named. After my debts and funeral expenses are paid, I devise and bequeath as follows. I will and devise that my Executor hereinafter named shall have erected around my grave a good and substantial iron railing and to have placed thereon a suitable monument and for this purpose my executor is authorized to expend the sum of ($300.00) Three Hundred Dollars. I will and devise unto my wife, Ann Maria Acton, the plantation on which I now reside together with all household and kitchen furniture therein to hold and possess during her single life and no longer and the sum of twelve hundred dollars shall be invested for her support and the interest thereon shall be paid to her during her single life and no longer. To my son, Emanuel F. Acton, I will and bequeath his note of hand due me for the sum of Five ($550.00) Hundred and Fifty Dollars together with all the interest that may accrue thereon after the time of my death. After my death, I will and devise that my executor shall sell my horse and buggy and out of the proceeds of the sale thereof he shall pay to the vestry of Paul’s (P.E.) Church, the sum of One ($100.00) Hundred Dollars or in case the said horse and buggy do not bring this amount then he is authorized to pay the deficiency out of any sum of money which may be in his hand and not otherwise devised. After the death of my wife, Ann Maria Acton, for the purpose of erecting a good and substantial iron railing around her grave and placing thereon a suitable tombstone, I authorize my executor to expend the sum of ($150.00) One Hundred and Fifty Dollars. After the death of my wife, Ann Maria Acton, I will and devise that my executor shall pay to my grandson, Plinny Moore (if he be of legal age or in case he is not then to his mother, Margaret A. Moore) for his use the sum of One ($100.00) Hundred Dollars. After the death of my wife, Ann Maria Acton, I will and devise that my executor shall sell my farm on which I now reside and also my lot of ground situated at Malcolm on the Southern Md. R.R. and the net sum of money realized from said sale, together with all the rest and residue of my estate not otherwise bequeathed shall be equally divided between my sons, William C. Acton, Christopher C. Acton, Eugene M.L. Acton, and my daughters, Margaret A. Moore, Eliza R. Langley and the children of my deceased daughter Maria C. Boswell said last named children of my daughter Maria C. Boswell deceased shall draw jointly one-sixth of the whole share (collectively) equal to those which their mother would be entitled to draw - were she living at the time of my wife’s death. And lastly I do hereby constitute and appoint Henry L. Mudd to be trustee for my wife, Ann Maria Acton and he is requested and instructed by me to see that she is properly taken care of and I also constitute and appoint the said Henry L. Mudd to be sole Executor of this my last will and testament. In testimony whereof I bequest set my hand and seal this sixteenth day of May in the year of our Lord Eighteen Hundred and ninety-two.
