A formatted version can be Viewed at http://www.usgwarchives.net/md/dorchester/wills/hayward-j.pdf John Hayward / Haywood (d1744) Will Dorchester County Maryland Maryland Hall of Records 23:485 (Microfilm SR 4417) Written 29 April 1743 Probate 13 April 1744 In the Name of God Amen The Twenty ninth day of April in the year of our Lord One Thousand and Seven Hundred and forty three I John Haywood of Dorchester County, in the province of Maryland being sick and weak in Body, but of perfect Sence and Memory thanks be give to God, Therefore, and Calling to mind, the uncertainty of this life and that all flesh must yield to death; do make Constitute and ordain this my Last Will and Testament revoking and annulling all former wills by me heretofore made and Confirming this & no other, Imprimis, I Give my Soul unto almighty God my saviour And Redeemer In whom I Trust assuredly to be Saved and my Body to be buried in such Christian and Decent manner, as it shall please my Executor hereafter named to appoint and as for such Worldly Goods as it hat pleased God to bestow on me, I Give and bequeath in manner and form following Item, I Give and bequeath unto my two Sons Francis and Thomas, the tract of Land Whereon I now Live Called Francis’s Cottage, and another Small Tract or parcel of Land Called the addition to Francis’s Cottage adjacent to the Other, to be Equally Divided betwixt them, and my Will is that my son Francis have the Lower moiety whereon my dwelling house stands and my Son Thomas, the upper most moiety to them the said Francis and Thomas and their heirs for Ever reserving however, and Willing that my [wife] have the use and Quiet Enjoyment of third part, of the Said Land, during her widowhood Item I Give to my Nephew Thomas Haywood Son of William Haywood Deceased One hundred acres of Land Out of the upper most part of a Tract of Land called Beaver Neck according to my Fathers Deed but my Will is that my Son John have the Said hundred Acres provided he Shall pay to my nephew Thomas as much Tobacco as will purchase the like Quantity of Equal Value Elsewhere Item, I Give to my son John Haywood all the remaining part of the aforesaid Land Called Beaver Neck to him and his heirs for ever provided that my said Son John, do procure for my Son William One hundred acres of Land in Some Other place, of Equal Value, with the Like quantity of Beaver Neck or on Default thereof, my Will and Desire is that my aforesaid Son John to forfeit unto my said son William One hundred acres out of the said Land Called Beaver Neck to him and his heirs forever. Item, I give and bequeath unto my son William Haywood, a negro Girl named Mole Item, I Give and bequeath to Loving Wife Sarah Haywood the remaining part of my negroes to be disposed of as shall this proper. Item, My Will and Desire is that the residue of my personal Estate, be Equally divided between my wife and children Lastly, I nominate appoint and Ordain my dear and well beloved Wife and my brother in Law Colonel Hooper Executor and Executrix of this my Last Will and Testament. Dor County On the 13{th} Day of April 1744 The reverend M{r} Thomas Airey and William James, two of Evidences to the Within will being sworn on the Holy Evangels of Almighty God, depose and Say that then that they saw, the Testator John Haywood Sign Seal publish and Declare the same as his Last Will and Testament and that at the time of his so doing he was to the Best of their apprehension of sound and disposing mind and memory, and that they together with the other Witness, William Lankfort Subscribed their names as Witnesses to the said Will in presence of the said Testator, and at his request. Sworn Before Henry Shippe Deputy Commisary of Dorch{r} County Maryland ? I do hereby renounce all the Right to the Executorship of the within Will of John Haywood of Dorchester County, Deceased, as Witness my hand the 13{th} day of April 1744, Henry Hooper Henry Shippe
