A formatted version can be Viewed at http://www.usgwarchives.net/md/dorchester/wills/hayward-w.pdf William Hayward (d.1774) Will Dorchester County MD Maryland Hall of Records 40:89 (Microfilm SR4434-1) Written 16 February 1774 Proved 28 March 1774 In the name of God amen I William Hayward of Dorchester County being very sick and weak of Body but of Sound Sence and memory bessed by God for the Same I do hereby make this my Last Will and Testament in manner and form following Revolking and making Null and void all former or other Wills heretofore by me made Vizt Imprimis I give and bequeath my Soul to Almighty God who gave it me with a full assurance of Pardon and Remission of all my Sins thro the and sufferings of my Blessed Saviour Jesus Christ and my Body to the Earth to receive such decent and Christian Burial as my herein appointed Executor shall seem meet and as for such worldly Estate as it hath pleased God to bless me with all I give and bequeath as followeth Vizt Item I give and bequeath unto my daughter Hannah all my Land and Tenements an Also all my Household Furniture an also one Negro wench named Nan and three negroe Children namely Sem(?) dido and diner to her my said daughter Hannah her Heirs and assigns for ever, but in case it should please God to take unto himself the Soul of my dear Child before shee arrives to the Age of Sixteen years old or hath Lawfull Issue it is then my will and desire that all my Estate both Real and Personal be equally divided between my Brothers and Sisters namely Francis, John, the Children of my Brother Thomas deceased, Mary Travers, Sarah Brannock, Priscilla Pitts and Roseannah Giffen and their Heirs and assigns for ever. Item it is my will and desire that my negroe wench Hester and her Child called Sue be sold to some person as convenient to her husband as possible and the money put out to use for the Benefit of my child till shee comes of age Item I give and bequeath unto my sister Sarah Brannack Ten Pounds common money to be paid by my Executor over and above her equal part before given. Item I give and bequeath unto my Brother Francis Hayward the service of a negroe man named Jack until my Child comes of age and in case my child should die as aforesaid it is then my will and desire he should keep him during life. It is also my will and desire that all my stock should be sold and after my just debts and the Legacy to my Sister Sarah Brannack are paid that the overplus should be put out to use as aforesaid for the benefit of my child as aforesaid and her Heirs for ever Lastly I do hereby nominate and appoint Francis Hayward my whole and sole Executor to this my Last will and Testament In Witness whereof I have hereunto set my hand and fixed my seal this Sixteenth day of February 1774. William (his mark) Hayward (seal) Joseph Ennalls Jun{r}, James Griffen, Lambearth Byrn At the foot of the aforegoing Will was thus written vizt Dorchester County On the 28{th} day of March Anno Domini 1774 Francis Hayward the appointed Executor in the aforegoing will made oath on the Holy Evangels of Almighty God that the aforegoing Instrument of writing is the true and only will and Testament of William Hayward late of Dorchester County deceased that hath come to his hands or possession and that he does not know nor ever heard of any other will made since by the said Testator. Dorchester County on the 28{th} day of March Anno Domini 1774 Joseph Ennalls Jun{r} and Lambert Byrn two of the subscribing witnesses to the aforegoing will being duly and solemntly sworn on the Holy Evangels of Almighty God deposed and said that they saw the Testator William Hayward sign the aforegoing will and heard him Publish and declare the same to be his Last Will and Testament that at the time of his so doing he was to the best of their apprehension of sound and disposing mind and memory and they together with James Griffen the other subscribing witness subscribed their respective names as witnesses thereunto in the presence of the Testator and at his Request.
