All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/md/mdfiles.htm ************************************************ File contributed for use in USGenWeb Archives by: Kathie Evans Kathie1448@aim.com November 3, 2009, 9:43 am Source: Last Will And Testament Written: March 13, 1864 Recorded: March 23, 1881 Sarah Ann Hubbard Filed:March 23 1881 In the name of God Amen.I SARAH ANN HUBBARD of Dorchester County in the State of Maryland,being in perfect health of body,and of sound and disposing mind,memory and understanding considering the uncertainty of death,and the uncertainty of the time thereof and bring desirous to settle my worldly affairs,and thereby be the better prepeared to leave this world when it may please God to call me home.I do therefor make and publish this my Last Will and Testament,in manner and form following;that is to say.First and principally I commit my soul into the hands of Almighty God,and my body to the earth,to be decently buried at the discretion of my excertrix early,herein as for named,and after my debts and funeral charges are paid,I devise and bequeath as follows. Item 1 I give and devise to my dearly beloved husband MICHAEL HUBART,my plantation where in I now dwell known by the nameof Hurlock regulationor by what other name or names it may be called,together with all other lands that I persisor whereafter me persis thru heir ship;law suter now depending,or otherwise or what number of acan they may contain or what cerenty,they may be located (in the state of Maryland) and if said Hubbard should die without children for him to dispose of them as he may think proper right an just. Item 2 I give and devise to my dearly beloved husband all my personal estate.But it is my wish and desire that he shell hold and keep together all my nigros that I now percess and shall provide well for them.Les the number be what they may or there names be what they may.It is also my wish that my dearly beloved husband Michael Hubard atend well to raising of one now small child called JULY JANE and see at all times that she is not miss used or ill treted by enneybody,and when she arrives at the age of sixteen he shell give her one extra suit of clothing such as he may think she shell deserve. To make this testamen mor plane and and and more fully understood I give and bequeath to my dear beloved husband MICHAEL HUBBARD all my reale persell a mixed astate of what it may consist at my death. And lastly I do hearby constitute and appoint my dear beloved husband MICHAEL HUBBARD to be sole executer of this my Last Will and Testament.Revoking and annulling all former wills by me heartofore maid.Rattifying and confirming this and none other to be my Last Will and Testament. In testamony whereof,I have whereinto set my hand and affixed my seal this thirtyth day March in the year of One Thousand Eighteen Hundred Sixty Four. SARAH ANN X(mark) HUBBARD Daniell (X his mark)Harper Thomas B(X his mark) Harper H.D Wright Elisha (X mark) Harper State of Maryland,Dorchester County to with: On the 23rd day of March Anno Dommi 1881,personaly appeared MICHAEL HUBBARD,the within named executor and made oath on the Holy Evaugely Almighty God that this paper or instrument of writing purporting to be the Last Will and Testament of SARAH ANN HUBBARD late of the said County,deceased ,was deposited in his hands for safe keeping by the said testatrix and said to be the best of his knowlege it is the true and whole Last Will and Testament of the said deceased and the he knows of no other of a younger date. And at the same time,personally appeared DANIEL HARPER,THOMAS B HARPER,HARRY D WRIGHT and ELISHA HARPER the subscribing witnesses to the aforgoing Last Will and Testament of MRS SARAH ANN HUBBARD late of the said county,deceased and made oath on the Holy Evaugely of Almighty God that they and each of them,did see the said testatrix sign and seal the said will,that they heard her publish,pronouce and declare the same to be her Last Will and Testament,that at the time of so doing the said testatrix was to the best of their apprehensions of sound and disposing mind,memory and understanding and that they respectively subscribed their names as witness to the said will in the presence and at the request of the said testatrix and in the presence of others.
