Witnesseth, that the Said William Albough for and in Consideration of the Sum of One hundred pounds current money to him in hand paid by the Said Zachariah Albough before the Ensealing and Delivery of these presents, the Receipt whereof the Said William Albough do hereby acknowledge Hath given, granted, Bargained, sold, alliened, Confirmed and made Over and by these presents doth give, grant, Bargain, sell, Confirm and made Over unto the Said Zachariah Albough his heirs and assigns for Ever all that tract or parcel of land called the Resurvey on Alboughs Delight Beginning at the beginning Tree of Albough's Delight and running thence South thirty two degrees west Ninety Six perches South four Degrees west One hundred and four perches South Seventy five degrees East thirty Eight perches North Sixty Seven Degrees East fifty Eight Perches north Eighteen perches East two hundred thirty three perches north Sixty two Degrees west Twenty Perches then with a straight line to the Beginning Containing and laid out for One hundred and thirty and three quarter acres of land more or less To have and to hold the said bargained land and Premises with the appurtenances thereon or thereunto belonging or in anywise appertaining unto him the Said Zachariah Albough his heirs and assigns for Ever to the only proper use and behoof and ---?] Of the Said Zachariah Albough his heirs and assigns and to no Other use intent or purpose whatsoever and the said William Albough doth for himself his heirs Executors and administrators Covenant and agree to and with the Said Zachariah Albough his heirs and assigns that he the Said William Albough and his heirs the afsd. tract of land called the Resurvey on Albough's Delight and Premises with the appurtenances unto the Said Zachariah Albough his heirs and assigns against all manner of persons Claiming any Right or title thereunto from by or under him or them, will well and sufficiently warrant and defend and further the said William Albough doth for himself his heirs Executors and administrators Covenant and agree to and with the Said Zachariah Albough his heirs and assigns that he the Said William Albough and his heirs shall and will from time to time and at all times hereafter at the Reasonable Request and at the Proper Cost and Charge of the Said Zachariah his heirs and assigns make, do, suffer and Execute or Cause and procure to be made, done, Suffered and Executed all and Every Such other and further act or acts, deed or deeds, Conveyance or Conveyances, assurance or assurances whatsoever for the further and better Conveying and assuring the hereby Bargained land and Premises unto the Said Zachariah Albough his heirs and assigns, be it by acknowledgement or by Enrolement or by any other ways or Means as by his or their Council caused in the law shall be reasonably advised, devised or required, Provided Such other instruments of writing contain no other Warrantee than is hereby already Express. In Testimony whereof I the said William Albough have hereunto Set my hand and Seal the day and year above written William Albough seal Signed Sealed and Delivered in presence of William Luckett, Evan Shelby The word delight between the ninteenth and twentieth being interlined before signed sealed and Delivered On the Back of which deed was the following Indorsements To Wit Augst. 20th 1768 Received of Zachariah Albough One hundred pounds current money being the Consideration money within mentioned. Witness Wm. Luckett, Evan Shelby............Wilm Albaugh Memorandum Augst. 20th 1768, came William Albough before us the subscribers two of his lordships Justices of the Peace for Frederick County and acknowledged the within Instrument of writing to be his act and Deed and the land and Premises therein mentioned to be the Right and Estate of the within named Zachariah Albough his heirs and assigns for Ever according to act of assembly in Such case late made and Provided, at the Same time came Magdalane Albough wife of the afsd. William Albough who being by us privately Examined Out of the hearing of her said husband relinquished her right of dower to the within mentioned land and Premises and acknowledged the same to be the Right and Estate of the within named Zachariah Albough his heirs and assigns for Ever, and Declared she did the Same willingly and Freely and was not compelled thereto by fear or threat from her Said husband or for fear of his displeasure. (Acknowledged before Willm. Luckett, Evan Shelby) Received Augst. 20th 1768 of Zachariah Albough five shillings and Threepence Sterling an Alienation Fee on the within land by Order of Bennett ?
