Frederick County Land Records – HS 8, 479

At the request of Peter Iler of Conrad the following deed is recorded the 23 
rd day of April 1839

This indenture made this first day of April in the year of our Lord one 
thousand eight hundred and thirty nine, between Daniel M. Kemp and Susana his 
wife of Frederick County in the State of Maryland of the one part and Peter 
Iler of Conrad of the County and State aforesaid of the other part.  
Witnesseth that the said Daniel M. Kemp and Susanna his wife hath for and in 
consideration of the sum of one hundred & fifty dollars current money of the 
United States to them in hand paid by the said Peter Iler of Contrad on or 
before the sealing and delivering of these presents the receipt whereof they 
the said Daniel M. Kemp and Susan his wife do hereby acknowledge and from 
every part or parcel thereof do hereby acquit Exonerate and discharge the said 
Peter Iler of Conrad his heirs executors & administrators they the said Daniel 
M. Kemp and Susana his wife have granted bargained and sold aliened enfeoffed 
and confirmed and by these presents do grant bargain and sell alien enfeoff 
and confirm unto the said Peter Iler of Conrod his heirs and assigns forever a 
tract of land called Good Hill, beginning for the same at the end of ninety 
two perches on the second line of the whole tract and running with said line 
reversed north thirty degrees west forty six perches then leaving said line 
north forty one perches quarter degree east thirty sixe and a half perches to 
the end of the second line on part of said Good Hill recently conveyed by 
Brooke Baker to Daniel M. Kemp and running with the lines of John Fogle of 
Henry south thirty two and a quarter degrees east forty five perches south 
fifty two degrees west thirty eight and one tenth perches to the middle place 
of the beginning containing ten acres and one half of land.  Together with all 
and singular the improvements rights liberties privileges and appurtenances 
whatsoever thereunto belonging or in any wise appertaining and all the estate 
right title interest claim or demand whatsoever of them said Daniel M. Kemp 
and Susanna his wife both at law and in equity.  Of in and out of the said 
land and premises and every part and parcel of the aforesaid land and premises 
and every part and parcel thereof as herby bargained and sold or meant 
mentioned or intended hereby so to be.  To have and to hold the said parcel of 
land & premises as aforesaid described or called together with their and every 
of their appurtenances thereunto belonging as aforesaid described unto the 
aforesaid Peter Iler of Conrad his heirs and assigns forever and to and for 
his or their only use behoof intent or purpose whatsoever and they the said 
Daniel M. Kemp and Susanna his wife for themselves their heirs executors and 
administrators do hereby covenant and agree to and with the said Peter Iler of 
Conrad his heirs executors administrators or assigns to warrant and forever 
defend to him or them the said parcel of land and premises as aforesaid 
described against all persons claiming any right title or part thereof by from 
or under them the said Daniel M Kemp & Susanna his wife and their heirs shall 
& will at anytime hereafter at the request of the said Peter Iler of Conrad 
his heirs or assigns execute & acknowledge any other deed or instrument of 
writing which may be necessary for the more effective granting and conveying 
al the right & title of them the said Daniel M. Kemp & Susanna his wife in and 
to the land & premises as aforesaid described with the appurtenances thereunto 
belonging unto the said Peter Iler of Conrad his heirs or assigns.  In Witness 
whereof they the said Daniel M. Kemp and Susanna his wife have hereunto set 
their hands and affixed their seals the day and year first within written.

Which was thus endorsed to wit
State of Maryland Frederick County to wit
On this day and year first within written personally appears Daniel M. Kemp & 
Susanna his wife of the county aforesaid being the party grantors within named 
before us the subscribers two Justices of the Peace for said county & 
acknowledged them??? Instrument of writing to be their act & deed the land and 
premises therein mentioned to be the right and estate of the within named 
Peter Iler of Conrad party grantor also therein named his heirs & assigns 
forever according to the true intent & meaning thereof & the acts of assembly 
in such cases made and provided.  And now at the same time Susan Kemp wife of 
the said Daniel M. Kemp being by us privately examined apart from and out of 
the hearing of her husband acknowledged that she does sign seal and make her 
acknowledgement of the same willingly and freely & without being induced 
thereto by fear or threats of or ill usage by her husband and further we do 
certify that we are satisfied of our own personal knowledge that they who have 
signed sealed & acknowleged the within deeds or instrument of writing are the 
very identical persons therein described taken & certified the day & year 
first within written.
