All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/md/mdfiles.htm ************************************************ File contributed for use in USGenWeb Archives by: Mark Ault meault@yahoo.com February 12, 2009, 11:37 am Lot 46 of Monocacy Manor Written: December 6, 1823 Recorded: December 8, 1823 Frederick County Land Records – JS 19 29 At the request of David Kemp & Daniel Link the following deed is recorded December 8th 1823 viz: This indenture made this sixth day of December in the year of our Lord eighteen hundred and twenty tree between Catherine Hedges relict widow of Joseph Hedges late of Frederick County deceased and state of State of Maryland of the one part and David Kemp and Daniel Link of the same County and State of the other part. Witneseth that whereas a schoolhouse has been erected on part of the land held by Joseph Hedges late of Frederick County deceased at the joint expense of a subscription of certain neighbours in the neighbourhood of said schoolhouse and a certain lot or portion of ground was appropriated for said schoolhouse on which the same is now erected and the said Joseph Hedges dec’d did in his lifetime agree and stipulate to make a conveyance for the same but he dying without carrying the same into effect but did in his lifetime make and duly execute his last will & testament in and by which said will he did give will and bequeath all his real estate unto his wife Catherine said will being duly authenticated and recorded in the Register of Wills office in the Frederick County Orphans Court reference thereunto being had will now fully appear and the said Catherine Hedges relict widow of Joseph Hedges dec’d being desirous to carry said original intention into full effect now this indenture further witneseth that the said Catherine Hedges for and in consideration of the sum of one dollar current money to her in hand paid before the insealing and delivering of these presents the receipt whereof is herby acknowledged doth hereby grant bargain sell alien enfeoff and confirm unto the said David Kemp and David Link in trust forever that lot or portion of ground laying and being in Frederick County State of Maryland and being part of Monocacy Manor designation by log number forty six Beginning for the out lines of said schoolhouse lot intended hereby to be conveyed at the end of two and one half perches on the sixth line of a lot or portion of ground laid off for Cornelious Cramer it being also part of the same lot or portion of land designated by lot number forty six conveyed by the said Catherine Hedges to Cornelius Cramer by deed duly acknowledged and recorded in one of the land records of Frederick County reference thereunto being had will now fully appear and running thence north forty seven degrees west seven perches north thirty three degrees east five and eight tenth perches to intersect the fifth line of the Resurvey on the second part of Surry it being the original lot number forty seven and also part of Monocacy Manor and with said fifth line of Surry south fifty seven degrees east seven perches to the beginning of Cornelious Cramers lot which is intended to begin on the same line of Surry there reversing Cornelious Cramers given line to the first place of beginning containing forty square perches of land be the same more or less together with all the right title interest claim and profit thereof to have and to hold the said lot portion or parcel of land in trust forever for the benefit and proper use of a school and nowe other and all and singular the said premises within mentioned and every part and parcel thereof with the appurtenances thereunto belonging unto them the said David Kemp and Daniel Link their heirs & assigns forever in Trust provide nevertheless the above mentioned lot portion or parcel of land shall forever remain as a public school or for public worship and for no other use interest or purpose and never hereafter be subject to be converted sold transferred or occupied for any other use intent or purpose by or from which any ???? advantage or profit can arise to any individual or individuals subscribers or contributors toward the erection of said schoolhouse or right in said lot portion or parcel of land hereby intended to be conveyed in any other way whatsoever then what may appertain to the benefit, support and advantage, connected with the promotion of a neighbourhood public school and public worship and for no other use intent or purpose whatsoever and the said Catherine Hedges doth covenant and agree for herself her heis executors and administrators upon the above conditions and none other the before mentioned lot portion or parcel of land with the appurtenances thereunto belonging and every part and parcel thereof and all & singular the buildings improvements rights liberty priveliges hereditaments and appurtenances whatsoever thereunto belonging and all the right title interest claim and profit thereof whatsoever of her the said Catherine Hedges of in or to said lot portion or parcel of land and every part and parcel thereof unto them the said David Kemp and Daniel Link and their heirs and assigns forever in trust and their successors forever after them for a public neighbourhood school or public worship against her the said Catherine Hedges her heirs and all persons claiming or to claim by from or under her or them shall will warrant & forever defend by these presents in witness whereof the said Catherine Hedges hath hereunto subscribed her name and affixed her seal the day and year first above written Signed seal & delivered in presence of Catherine Hedges {seal} Brooks Baker, Midd’n Smith Which is thus endorsed viz State of Maryland Frederick County to wit Be it remembered that on the sixth day of December in the year one thousand eight hundred and twenty three personally appeared before us the subscribers two of the Justices of the Peace in and for said county Catharine Hedges and acknowledge the within instrument to be her act and deed and the premises therein mentioned and intended to be conveyed the right and property of David Kemp and Daniel Link their heirs and assigns forever in trust according to the true intent and meaning thereof and according to the acts of assembly in such cases made and provided.
