Clark Land Record STH-278 Pages 257-259 Frederick County Courthouse Frederick County, Maryland At the request of Emma J. Clark the following Deed is received for record and recorded February 18th 1907 at 1:05 o’clock PM. This deed made this 25th day of January nineteen hundred and seven, by us William J. Peters and Rachael Peters his wife, Waynesboro, State of Pennsylvania, Claudia M. Rosensteel and Charles O. Rosensteel her husband, and Bernard F. Peters, of Frederick County, State of Maryland, and John A. Peters, of York, State of Pennsylvania. Whereas John A. Peters Sr. late of Frederick County, State of Maryland, did testate, and by his said will bearing date on the 14th day of September 1895, duly admitted to probate in the Orphan’s Court of Frederick County, he devised and bequeathed all his real estate to his wife Mary H. Peters during her natural life and after her death to the said William J. Peters, John A. Peters, Claudia M. Rosensteel, and Bernard F. Peters, the children of the said John A. Peters Sr. and whereas the said Mary H. Peters has since died and said real estate has vested under said with in said legaters who also we heirs at of the said John A. Peters Sr. who have sold the said real estate herein after described to a certain Emma J. Clark wife of John H. Clark at and for the sum of $200.00. Now therefore this deed witnessed that for and in consideration of the said sum of $200.00, $50.00 of which we and each of us kindly acknowledge that we have received as our and each of our respective share of the same, and in consideration thereof we the said William J. Peters and Rachael Peters his wife, John A. Peters, Claudia M. Rosensteel and Charles O. Rosensteel her husband, and Bernard F. Peters, hereby grant and convey to the said Emma J. Clark wife of John H. Clark, all that tract or parcel of land situate lying and being in the Fifth Election District of Frederick County, State of Maryland, of which the said John A. Peters Sr did seized and possessed particularly described as follows Viz: Beginning for the same at a point on the side of the Mountain Road near the corner of Augustus Kreitz’s lot and running thence with the line of Wagner’s land South 69 and ½ degrees West 28 and 44/100 perches to a stone near a large chestnut tree with a line of Mrs John J. Peddicord’s land thence with the line of the said land South 12 and ¼ degrees East 17 and 8/100 perches to a stone planted on the same line thence North 50 degrees East 31 and 24/100 perches to a point on the side of a reserved road North 18 and ¾ degrees West 11 and 12/100 perches to the beginning containing two acres two rods and twenty one perches of land more or less. Being the same tract of land described in a deed from J.C. Rosensteel and wife to the said John A. Peters Sr. bearing the date of the 6th day of October 1888 duly recorded in Liber WIP No. 6, Folio 702 one of the land records of Frederick County, less that portion of the above described tract particularly described as follows. Viz: Beginning for the same at a point on the side of a reserved road said point being the third corner of the said John A. Peters Sr land, running thence with the reserve road North 18 and ¾ degrees West 59 feet; thence South 59 degrees West 100 feet to a stone, thence South 18 and ¾ degrees East 55 feet; thence with the line of said Addie Kelley and North 59 degrees East 100 feet to the beginning. Containing 5500 square feet of ground and also the use of the above mentioned reserve road. The said tract or parcel of land and use of the reserved road being particularly described in a deed from John A. Peters Sr. and his wife Mary H. Peters to Augustus Kreitz being dated the 1st day of February 1891 and duly recorded in Liber WIP No. 13 Folio 431. one of the land records of Frederick County. Together with the improvements on said property and the rights and opportunities there to belonging, together with the right to use the road reserved for the benefit of the said property hereby granted from said Joseph C. Rosensteel, and his wife to the said John A. Peters Sr. mentioned in the said deed above referred to, to have and to hold the above granted property for the proper sell and benefit of the Emma J. Clark, wife of John H. Clark her heirs and assigns forever in its fee. Witness our hands and seals: William J. Peters Rachael Peters Claudia M. Rosensteel Charles O. Rosensteel Bernard F. Rosensteel and Charles O. Rosensteel her husband and Bernard F. Peters, and did each acknowledge the aforegoing deed to be their respective act.
