Between Ralphael Taney and William Diggs of the One part and Charles Fair of the other part Witnesseth that the said Raphael Taney and William Diggs for and in Consideration of the sum of Forty Five pounds to them in hand paid hath given granted Bargained and Sold and by those presents they the said Raphael Taney and William Diggs for themselves their Heirs doth give grant Bargain Sell Alien (sp) Enforce(sp) Confirm and Make Over unto the said Charles Fair his Heirs and Assigns all that Tract or Parcel of Land being part of the Resurvey on Brothers Agreement. Beginning at the End of the Twenty perches in Nineteenth line* of the Resurvey and Running thence with the said Line . North Nineteen Degrees West Twenty Four perches thence North Twenty Nine Degrees East One Hundred and Six perches Thence South Forty Three degrees East One Hundred and Four perches Thence by a Direct Line to the Beginning Containing Fifty Nine Acres together with all and Singular its Appurtenances To have and to Hold the same unto Him the said Charles Fair his Heirs and Assigns for Ever and the said Raphael Taney and William Diggs doth hereby Covenant and Agree to Warrant and Defend the aforesaid parcel of Land and Transfer unto the said Charles Fair his Heirs and Assigns against them the said Raphael Taney and William Diggs and against all Persons(sp) Claiming or that shall Claim any Right or Title Thereto under them the said Raphael Taney Page 328 and William Diggs or their Heirs aforesaid the said Charles^or his Heirs or Assigns do pay the Quit Rents now due on the said Land In Witnesseth Whereof the Parties to these presents have hereunto Set their Hands and Affixed their Seals the day and Year first above Written ----------- Signed Sealed and Delivered In the presence of ----- Raphael Taney and Wm. (sp) Henry Reeder-----(sp) On the Back of which Deed was the following Endorsements Received from Charles Fair the Sum of Forty Five pounds Pennsylvania Currency being the Consideration Money for the within(sp) Land Witnesses Jno Reeder Jun. (sp) Henry Reeder Wm. Diggs St. Mary’s County October 27th 1773 this day came before us their subscribes here two of his Lordships Justices for the County Aforesaid the within Mentioned Raphael Taney and William Diggs and Acknowledged the within Mentioned Land to be the Right Title and property of the within Mentioned Charles Fair and his Heirs at the same Time Elenor(sp) the wife of the Within Named Raphael Taney and Catherine Wife of the within Named William Diggs beign by us presently Examined and out of the hearing of their said Subscribe(sp) did Acknowledge that they Released all their Page 329 Right of Dower in the within Mentioned Land Freely Voluntarily and of their Own Accord without being Induced to it by threats or injury(sp) by their said Husband or the Apprehensions of their displeasure Then before and Certified by Jno Reeder Jun. Henry Reeder I do hereby Certify that the above Named John Reeder Junior and Henry Reeder Gentlemen before whom the within Deed was Acknowledged were at the Time of Taker (sp) the same and now are Two of the Right Honourable The Proprietors Justices of the peace for the County of St. Mary’s duly Authorized and Assigned unto whom Due faith and Creaht(sp) and Ought to given both within Court and Out(sp) thereof(sp) In testimony whereof I have here onto Set my Hand and Affixed the Public Seal of The Office this Twenty Ninth day of October Anno Domino Seventeen Hundred and Seventy Three D Wolftenholen M (sp) Received 18th November 1773 of Charles Fair Two Shillings and Four Penes half penny Sterling for an Alienation Fine** on the within Land Wm. M Beall *This 19th line is in error which was corrected with Deed dated 17 June 1788 should be 23rd line, Land Rec. Bk WR-8 page 103. **A fine on alienation, in feudal law, was a sum of money paid to the lord by a tenant when he had occasion to make over his land to another. It is similar in nature to a relief, a payment made by an heir to the lord to receive his inheritance. The term fine is also a synonum for a premium, a sum paid to the landlord at the start of a lease or for the extension of the term of an exisitng lease (for example, to add an additional life to the term of a lease for lives).
