The submitter has given permission to the USGenWeb Archives to store the file permanently for free access. http://www.usgwarchives.net *********************************************************************** Will of John Albaugh Sr. Frederick Co., MD Liber R B 1 Folio 167, 168 In The Name of God Amen I John Albaugh Senior of Frederick County and state of Maryland being in perfect health of Body and of sound and disposing mind memory and understanding considering the certainty of death and the uncertainty of the time thereof and being desirous to settle my Worldly affairs and thereby be the better prepared to leave this world when it shall please God to call me home do therefore make and Publish this my last will and Testament in manner and form following that is to say first and principally I commit my soul into the hands of Almighty God and my body to the Earth to be decently Buried at the discretion of my Executor hereinafter named Secondly it is my will and desire that after my Decease all my real and personal Estate is to be sold by Executor hereinafter named to the best advantage the Real Estate consisting of Two hundred and two Acres of Land more or less called the resurvey on Chestnut Levell and to be conveyed by a good and Lawful Deed by my Executor hereinafter named and after my Just Debts and funeral charges are paid the money arising out of the sales of my Estate is to be Equally divided amongst all my children namely William Albaugh, Philip Albaugh (heirs), Anna Dim Comfer, John Albaugh, Mary Steel, Julian Albaugh, Susannah Eador, Daniel Albaugh, Elisabeth Roads and Catherine Smith all to have Share and share alike, the heirs of Philip Albaugh are to have but one share and that to be Equally divided among them Share and Share alike And Lastly I constitute and appoint my beloved son John Albaugh to be sole Executor of this my last will and Testament revoking and annulling all former wills by me heretofore made ratifying and confirming this and none other to be my last will and Testament In Testimony whereof I have hereunto set my hand and Affixed my seal this twenty fourth day of April Eighteen hundred and ten John Albaugh Senr. , His mark, seal Signed Sealed Published and Delivered by John Albaugh the above named Testator as and for his last will and Testament in the presence of us who at the request in his presence and in the presence of each other have Subscribed our names as Witnesses thereto Daniel Etzler, Rinehart Waltz, Abm. Albaugh Frederick County to wit on the 23rd day of March 1811 Then came John Albaugh and made Oath on the holy Evangels of Almighty God that the foregoing Instrument of writing is the true whole will and Testament of John Albaugh Senr. late of Frederick County Deceased that hath come to his hands and possession and that he Doth not know of any other Richd. Butler Regr. Frederick County to wit on the 23rd day of March 1811 then came Daniel Etzler & Rinehart Waltz two of the Subscribing witnesses to the foregoing and Annexed last will and Testament of John Albaugh Senr. late of Frederick County Deceased and made oath on the holy Evangels of Almighty God that they did see the Testator therein named Sign & seal this will, that they heard him publish pronounce and declare the same to be his last will and Testament that at the time of his so doing he was to the best of their apprehensions of a sound and Disposing mind memory and understanding that they respectively Subscribed their names as witnesses to this will in the presence and at the request of the Testator and all in the presence of each other Richd.
