The submitter has given permission to the USGenWeb Archives to store the file permanently for free access. http://www.usgwarchives.net *********************************************************************** Will of Zachariah Albaugh II Frederick Co., MD Liber G M I Folio 258, 259, 260 In the Name of God Amen, I Zachariah Albaugh Senr. of Frederick County in the State of Maryland, Farmer, being sick and weak in Body but of sound Mind and Memory thanks to God for the same and calling to mind the Uncertainty of this transitory Life, and that it is a Duty incumbent on me to settle my temporal affairs whilst Providence permits me to enjoy the power to perform it with propriety do for that purpose make and ordain the following, my Last Will and Testament in Manner & Form to Wit. Imprimus it is my Will and Desire that my just Debts and the Expenses of my Burial be first paid out of my Estate by my Executors hereafter mentioned named. Item I give and Bequeath unto my Dear Wife Susannah Albaugh the feather Bed on which she lays and the Furniture thereto belonging & two Cows which she shall choose out of my Stock of Cattle. Item I give and Bequeath unto my said Wife and my Son Zachariah Albaugh my Land and Plantation whereon I now live, for and during the Term of nine years after my Decease for them to live on & work for the maintenance of themselves and my Children while unable to maintain themselves. And after the Expiration of the said nine years, It is my Will and I do direct that my said Land and Plantation containing one hundred and twenty five acres more or less be sold by my Executor to the best advantage at public Sale, and the Money arising therefrom I give and Bequeath to be equally divided amongst my said Wife Susannah Albaugh and all my Children, share and Share alike. And if any of my Children should die before they arrive at Age or without lawful Issue Heir, that then the Survivors shall inherit equally the part or portion of such Child or Children who may die as aforesaid. Item it is my Will that the Grain which is on my Plantation and the Wool now in the House as well as the Meat to be killed this Fall be used by my Executors for the Support & Benefit of themselves and my Children. Item I give and Bequeath to my Son David Albaugh five pounds Current Money to be paid out of my Estate by my Executors. Item I give and Bequeath all the Rest & Residue of my Estate be it of what Nature or Kind so ever, unto my said Wife and my Children to be equally divided share and Share alike. And in Case of the Death of any of them before they come to age or hath legal Issue, their Part to go as the Money from the Sale of the Land is directed in that case. And lastly I do nominate and appoint my Dear Wife Susannah Albaugh and my Son Zachariah Albaugh Executors of this my Will, & Guardians & Trustees to my Children, until they shall arrive at Age respectively, hereby revoking all former Wills by me made, if any such I have made, Ratifying and confirming this only to be my Last Will and Testament. In Witness whereof I have hereunto set my Hand and affixed my Seal this 4th Day of July in the year of our Lord God one thousand seven hundred and eighty two. Albaugh David Plain Henry Eller Frederick County Augst. 19, 1782 Then came Susannah Albaugh and Zachariah Albaugh and solemnly affirmed that the aforegoing Instrument of Writing is the true and whole Will and Testament of Zachariah Albaugh late of Frederick County decd. that hath come to their Hands and possession & that they doth not know of any other. Geo. Murdock Regr Frederick County August 19, 1782 Then came William Albaugh David Plain and Henry Eller the three subscribing Witnesses to the within Last Will and Testament of Zachariah Albaugh late of Frederick County deceased, and severally affirmed and made oath on the Holy Evangelists of Almighty God, that they did see the Testator therein named sign & Seal this Will, and that they heard him publish pronounce and declare the same to be his Last Will and Testament, that at the Time of his so doing he was to the best of their apprehensions of sound and disposing Mind Memory and Understanding, and that they respectively subscribed their Names as Witnesses to this Will in the presence and at the Request of the Testator & in the presence of each other. Although Zachariah does not name all of the children, Susannah's will dated 27 Mar 1816 and filed 26 Feb 1821 in Huntingdon Co., PA names sons David, Stephen and daughters Hannah Stoner, Susan, Betsey and Catherine. Susannah's last name Zuck was spelled Sook in this document. ]
