I Luke Davis of Frederick County and State of Maryland being sick and weak in body but of sound mind and memory and understanding considering the certainty of Death and the uncertainty of the time thereof and being desirous to settle my worldly affairs and thereby be better prepared to leave this world when it shall please God to call me hence, do therefore make and publish my last will and Testament in manner and form following That is to say - First my will and desire is that my Tobacco now in the house may be packed and carried to market and sold by my Executor hereafter named at or before the first day of September next ensuing and the money arising from the sale of the same be paid by my Executor into the hands of William Hobbs of Saml. for Rent due Joshua Waddington of New York which is one hundred and thrirty two pounds ten shillings and eleven pence current money and after the above described rent is paid as above directed my will and desire is as to the remainder part of my personal Estate after my just Debts and funeral charges are paid and my wife's third taken out - my will and desire is that the remainder part may be sold by my Executor and the money arising from the same be equally Divided among all my children in equal portion share and share alike. Item my will and desire is that all my Real Estate lying and being in Ann Arundel County where my son John Davis now lives, after my wife's third is taken out may be sold within Six months after my Decease by my Executor herein after named, who I give full power to sell and convey the same by a good and Sufficient Deed in Law, and my will and desire is that the money arising from the sale of the said real Estate be equally Divided among all my children in Equal portion share and share alike. And Lastly I do hereby constitute and appoint my beloved Son Joshua Davis to be sole Executor of this my last will and Testament revoking and annulling all former wills by me heretofore made ratifying & confirming this and none other to be my last will and Testament. In Testimony whereof I have hereunto set my hand and affixed my seal this Twenty ninth day of May in the year eighteen hundred and Six. Signed sealed published and Declared by Luke Davis the above named Testator as and for his last will and Testament in the presence of us who at his request and in his presence have Subscribed our names as witnessthereto Thomas Norris, John Richards (his mark) Luke Davis (seal) William Hobbs (of Saml.) Frederick County to wit on the 20th day of August 1806 Then came Joshua Davis and made Oath on the Holy Evangels of Almighty God the foregoing Instrument of writing is the true whole will and Testament of Luke Davis late of Frederick County Deceased that hath come to his hands and posession and that he doth not know of any other. Richard Butler, Reg'r Frederick County to wit on the 20th day of August 1806 then came Thomas Norris and John Richards two of the Subscribing witnesses to the foregoing last will and Testament of Luke Davis late of Frederick County Deceased and made Oath on the Holy Evangels of Almighty God that they did see the Testator therein named Sign and seal this will that they heard him publish pronounce and declare the same to be his last will and Testament that at the time of his so doing he was to the best of their apprehensions of a sound and disposing mind memory and understanding that they respectively subscribed their names as witnesses to this will in the presence and at the request of the Testator and that they did also see William Hobbs (of Saml.) the other Subscribing witness Sign his name as a witness to said will in the Presence and at the request of the Testator and all in the presence of each other.
