I Jacob HALLER of Frederick Town in Frederick County & State of Maryland. Brick maker, being sick and weak in body but of sound & disposing mind & memory & understanding do make and publish this my last will and Testament in manner & form following -- That is to say First I commit my body to the earth to be decently buried and after payment of my just debts and funeral charges. I dispose of my Real and Personal Estate as follows. Item - it is my will and desire that my beloved wife Mary do and shall keep possession of the house & lott I now occupy during her widowhood -- and should my said wife Mary contract matrimony after my death if she chooses to live with her husband on the property aforesaid then in that case he or her are to pay rent at a value that may be judged by man & the rent to be equally divided among my lis children first George, second Margaret, third Jacob, fourth Mary, fifth Catherine & sixth Philip. Item - I give and bequeath to my son Geroge all my right title claim & interest that I have in a house & Lott formerly belonging to my father-in-law Michael HORVATER lying in Frederick Town & State above mentioned. And lastly as to all the rest residue and remainder of my personal estate goods and chattels of what kind & nature soever I give and bequeath the same to my beloved wife where of I have hereunto set my hand and seal this thirtieth day of April in the year of our Lord one thousand eight hundred & seven. Signed sealed published and declared by the above named his Jacob HALLER to be his last will & testament in the Jacob + HALLER presence of us who have hereto subscribed our names mark as witness in the presence of the testator Henry LILLY James GARNER Rich. ARMSTRONG Frederick County to wit on the 25th day of May 1807 then came Henry LILLY and Richard ARMSTRONG two of the subscribing witnesses to the fore going last will and testament of Jacob HALLER late of Frederick County deceased and made oath on the holy Evangels of Almighty God that they did see the testator therin named sign and seal this will that they heard him publish pronounce and declare the same to be his last will & testament. That at the time of his so doing he was to the best of their appehensions respectively subscribed their names as witnesses to this will in the presence and at the request of the testator and that they did also see James GARNER the other subscribing witness sign his name as a witness to said will in the presence and at the request of the testator and all in the presence of each other.
