All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/md/mdfiles.htm ************************************************ Be it remembered that I Adam Klay senr of Frederick County and state of Maryland being of sound and disposing mind memory and understanding do make and ordain this my last will and Testament in manner and form following to wit -- Imprimis It is my will that all my Just debts be paid out of my personal Estate by my Executor hereafter named Item 2d I Give unto my son George Klay his heirs and assigns forever the following lands to wit part of Cowmans Manor part of the Resurvey on the land of promise, and part of Plummers Lick contained within the following metes and Bounds. Begining to Include the different parts into one survey, at the Original beginning of Cowmans Manor and running thence with the lines of a deed given by John Cowman to Adam Klay for Two Hundred and Sixty two acres for part of Cowmans manor and part of the resurvey on the land of promise the following Courses, North Seventy three & three quarter degs east sixty Eight perches north eighty seven & a quarter Degs east fifty four and a half perches North seventeen Degs East one Hundred and thirty one perches South seventy five Degs West one hundred and thirty five perches to intersect the tenth line of Cowmans mannor and with said line reverse North ten and three quarter degrees west forty one perches to a stone, at the beginning of said line then south seventy nine degs West twenty eight perches to a stone at the end of the fifth line of Plummers Lick & with said line south sixty five degrees west fifty four & a half perches to a stone, then by a straight line to the first place of Beginning containing one Hundred and thirty acres. Item 3d I Give unto my son Samuel Klay his heirs and assigns forever all the remainder part if the land (not left to George) that shall be contained in the deed from John Cowman to Adam Klay for two Hundred and Sixty two acres for part of Cowmans mannor and part of the resurvey on the land of promise Deed dated in Eighteen Hundred or Eighteen Hundred and one. Item 4 I do hereby empower and authorize my Executor hereafter named to sell and convey by a good and lawfull deed in fee simple all the residue of my lands not heretofore bequeathed as soon as my personal Estate and the moneys arising therefrom, it is my will and desire, that it Shall be distributed in the following manner to wit, In the first place to pay unto my daughters Anna Baker, Rebeccah Faener, Elizabeth Klay and the children of my deceased daughter Mary Rine two Hundred Dollars that is to say two Hundred Dollars to each of my said Daughters as also two Hundred Dollars to the Children of Mary Rine and the Balance of money arising from my lands and personal estate to be equally divided among my following named Children to wit, my son Adam Klay my Daughters Anna Baker, Eve Snider Susanna Stewart Rebeccah Faener Elizabeth Klay and the Children of my daughter Mary Rine deceased there mothers part to be equally divided among them. And Lastly I constitute and appoint my son George Klay Executor of this my last will and Testament ratifying this and none other to be my last will and Testament. In witness whereof I the said Adam Klay have hereunto set my hand and seal this third day of April in the year of our Lord Eighteen Hundred and Eight. Adam Klee {seal} Signed sealed published and declared by the said Adam Klay to be his last will and Testament in the presence of us who in his presence at his request and in the presence of each other have subscribed our names Jacob Waters James Whiffing Peter Kemp Jun Frederick County to wit: On the 24th day of February 1825 then Came George Klay and made Oath on the Holy Evangely of Almighty God that the foregoing Instrument of writing is the true whole will and Testament of Adam Klay late of Frederick County Deceased, that hath come to his hands and possession and that he doth not know of any other. Test Henry Steiner Reg Frederick County to wit: On the 24th day of February 1825 then Came Peter Kemp one of the subscribing witnesses to the foregoing Last will and Testament of Adam Klay late of Frederick County deceased, and made oath on the Holy Evangely of Almighty God that he did see the Testator therein named sign this will, that he heard him publish, pronounce and declare the same to be his last will and Testament, that at the time of his so doing he was to the best of their apprehensions of a sound and disposing mind, memory and understanding, that he did also see Jacob Waters and James Whiffing the other subscribing witnesses to this will sign their names as witnesses to said will in the presence and at the request of the Testator and all in the presence of each other.
