Peters, Will – Mary Helena Peters, Executrix In the name of God, Amen. I, John A. Peters, of Frederick County in the State of Maryland being of sound and disposing mind, memory and understanding, do hereby make and publish this my last will and Testament in manner and form following, that is to say, first and principally I commit my soul into the hands of Almighty God and my body to the earth to be decently buried at the discretion of my Executrix hereinafter named and after my debts and funeral charges are paid. I devise and bequeath as follows: To my beloved wife Mary Helena I give all my real and personal property and all I have or possess as long as she lives, and after her death it is to be divided in share and share alike to each of my children. I appoint my beloved wife Mary Helena to be sole executrix of this my last will and Testament, ratifying and confirming this and none other to be my last will and Testament. In testimony whereof I have hereunto set my hand and affixed my seal this fourteenth day of September 1895. His Mark - X – John A. Peters Signed sealed published and declared by John A. Peters the above named Testator as and for his will and Testament in the presence of us, who at his request in his presence, and in the presence of each other have subscribed our names and witness thereto Witness: Augustine Wagner Samuel A. Hemler J. G. Troxel Maryland, Frederick County to Wit: On this 15 day of October 1895, came J. G. Troxel and made oath on the Holy Evangely of Almighty God, that the aforegoing instrument of writing is the true whole Will and Testament of John A. Peters late of Frederick County, deceased, that has come to his hands and possession: that he received the same from the Testator for safe keeping, and that he does not know of any other of a later date. Test: James K. Waters Register of Wills for Frederick County Maryland, Frederick County to Wit: On this 15 day of October 1895, came Augustine Wagner, Samuel A. Hemler, and J. G. Troxel the subscribing witnesses to the aforegoing last Will and Testament of John A. Peters late of Frederick County, deceased, and made oath on the Holy Evangely of Almighty God, that they did see John A. Peters the Testator therein named, sign and seal this Will: that they heard him publish, pronounce and declare the same to be his last Will and Testament: that at the time of his doing so he was, to the best of their apprehension of sound and disposing mind, memory and understanding, and capable of executing a valid deed or contract, and that they respectively subscribed their names as Witnesses to said Will, in the presence of and at the request of the Testator and that they did also see each other subscribing witness sign his name as Witness to said Will, at the request of the Testator in his presence, and all in the presence of each other. Test: James K. Waters Register of Wills for Frederick County In The Orphans’ Court of Frederick County: The Court after having carefully examined the above last Will and Testament of John A. Peters, late of Frederick County, deceased, and also the evidence adduced as to its validity. Orders and Decrees this 15 day of October, AD 1895 that the same be admitted to probate in this Court as the true and genuine last Will and Testament of the said John A. Peters, deceased.
