I am Philip Shanck yeoman of Frederick County State of Maryland and very sick and weak but of perfect sense and memory and as it came to my mind that the almighty God has appointed for every man to die therefore I have considered to make and ordain this my last will and testament wherein I have been blessed with in the naturally world and goods so as it my ???? after my decease may be divided in shared in peace. First I commend my soul in the hand of the Allmighty God who has giveth and my body to the earth to be buried in a Christian manner where to rest to the day of resurrection of all the death and where everyone will receive the reward for his deed done in the body. Secondly I give and bequeath to my dearly & beloved wife Moly the land and place where she live on for the use and support & maintenance for her on life and the children. Where she is to keep the children in a good Christian mannor & Regal orders & where the two oldest of the boy! s as Daniel and John are to stay with her so long as the single and to work the place as usual and manage the same as the mother in peace & help their mother raise the small children. Thirdly I ordain and advise that the place shall be in my wife’s hand so long she will remain a widow and in cause she would marry again then the place is to be sold and she is to have only Fifty pounds out of it for her share and all the other money the said land will bring is to be divided in like share to the children excepted one should be unruly and disobedient to his mother and the two oldest brothers as shall be in there power to disheir the some interoly and all the children is on age is to have there portion of the money and all them under age is to be but out on interest there age. Fourthly I ordain and ????? if my wife and the two oldest of the boys if to agree peaceable to Sale the said land the shall have a powerfull authority to make a good title for the same as my wife Moly Sh! ank and Daniel and John Shank and the shall be in the same way directe d as the first said for all the children. Fifthly I ordain and advise then any of the children is to be married is to live the place without it is agreeable to thee mother with the other son and he cannot make any demand for his share so long his mother is at life excepted she may freely when she can spare give him what she please and keep it in a regular account where it shall be in part of his share of the estate. Sixthly I ordain and advise that all my debts shall be of a just accounts by my wife and Daniel and John Shank both my sons and the shall have a full right and authority to demand and collect and receive by power of law all my debts notes bonds and other account and book debts which are not paid before my death and this I ordain and make it my last will and testament and no other before made shall have any effect or power hereafter whereas I have fixed & set hereunto my hand and seal this tenth day of April Seventeen hundred & ninety five. Frederick County, June 24th 1795, then came Molay Shank Daniel Shank and John Shank and Solomnly affirmed & Declared that the aforegoing Instrument of writing the true and whole last will & testament of Philip Shank late of Frederick County deceased that hath come to their hands and possession and that the do not know of any other. Geog Murdock, Reg Frederick County, June 24th 1795, then came Peter Lislor (?) and Joseph Myers the two subscribing witnesses to the aforegoing last will and testament of Philip Shank late of Frederick County dec’d and solomenly affirmed and declared that they did see the testator therein named sign and seal this will that they heard him publish pronounce and declare the same to be his last will and testament that at the time of his so doing he was to the best of their apprehensions of a sound and disposing mind memory and understanding that they respectively subscribedtheir names as witnesses to this will in the presence and at the request of the testator and in the presence of each other.
