In the Name of God Amen, This thirtyeth Day of December one thousand seven hundred & eighty I Martin SMITH of Frederick County and State of Maryland Farmer being sick and weak in Body but of perfect Mind & Memory thanks be unto God for the same and calling unto mind that it is appointed once for all men to die. I do make this my last Will & Testament and first I give and Bequeath my Soul into the Hand of Almighty God my Heavenly Father that gave it Hoping for the Forgiveness of all my Sins through the Merits and Intercesstions of Jesus Christ my Blessed Redeemer, and my Body I leave to be Buryed in a Christian-Like Manner at the Discretion of my Executor hereafter Named, Nothing Doubting but that I Shall receive the same again at the General Resurrection, and as for my worldly Estate wherewith it hath Pleased almighty God to bless me in this Life with I give and Dispose of the same in the Manner and Form following. Imprimiss I Give and Bequeath unto my beloved Wife Catherine SMITH my Bed & Furniture, one Cow & two Sheep to her for and during her natural Life, and after her Decease to my Son Adam SMITH, to him his Heirs and assigns forever. Item, Whereas I have assigned over the Lease of Land whereon I now live unto my Son Adam SMITH and for other Devises hereafter to be mentioned, it is my Will and desire that my Son Adam SMITH do Lett & Give unto my Wife Catherine SMITH, Liberty of liveing in the Dwelling House wherein I Now Live for and during her Natural Life, and allso that my Son Adam SMITH give unto my Wife Catherine SMITH yearly and every year for and During her natural Life, fifteen Bushells of Wheat two Bushells of Rye one hundred weight of Pork & to Sew one Quarter of an acre of Ground in Flax and Hay for one Cow and two Sheep and to have Liberty of using all the Household Goods for and during her natural Life & then to go to my Son Adam SMITH to him his Heirs & assigns forever. Item I give and Bequeath unto my Daughter Catherine PACKENNER Two hundred Pounds old Continental money or the Value thereof in New Continental Money to her & her heirs & assigns for Ever. Item I give & Bequeath unto my Daughter Charity ALLBAUGH Fifteen Pounds old Continental Money or the Value thereof in new Continental Money to her & her Heirs and assigns for Ever. Item I give and Bequeath unto my Son Adam SMITH all the Remainder of my Estate (Not Already Bequeathed) to him his heirs and assigns forever. And Lastly I Constitute Ordain and Appoint my well Beloved Son Adam SMITH my whole and Sole Executor of this my Last Will and Testament, hereby revokeing all Former Wills before this by me made, Ratifying and confirming this and no other to be my Last Will and Testament. Then came Adam SMITH and made oath on the Holy Evangelists of Almighty God that the aforegoing or within Instrument of Writing is the true and whole Will and Testament of Martin SMITH late of Frederick County decd that hath come to his Hands or possession and that he doth not know of any other. Then came Joseph WOOD, William HARTSOCK and Anglebart HARTSOCK the three subscribing Witnesses to the aforegoing or within last Will and Testament of Martin SMITH late of Frederick County Decd & severally made Oath on the Holy evangelists of Almighty God that they did see the Testator therein named sign and seal this Will, that they heard him publish pronounce and declare the same to be his last Will & Testament that at the Time of his so doing he was to the best of their apprehensions of sound and disposing mind memory and understanding that they respectively subscribed their Names as Witnesses to this Will in the presence and at the Request of the Testator and in the presence of each other.
