All Rights Reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/md/mdfiles.htm ********************************************************* Will of Peter Troxel Frederick County Wills Liber/Folio GM-3-271 Frederick County Court House Frederick County, Maryland In The Name of God Amen the fifteenth day of December in the year of our Lord one thousand seven hundred and ninety eight I Peter Troxel of Frederick County and State of Maryland being weak in Body but of sound mind and memory thanks be unto God calling unto mind the mortality of my Body and knowing that it is appointed for all men once to die do make and ordain this my last will and Testament in manner following Principally and first of all I recommend my Soul into the hands of god that gave it and for my Body I recommend it to the Earth to be Buried in a Christian and decent like manner at the Discretion of my Executors nothing Doubting but at the general Resurrection I shall receive the same again by the mighty power of God and as Touching such worldly Estate wherewith it hath pleased god to bless me with in this life I give devise & Dispose of the same in the following manner and form Imprimis my will is that all my Just Debts and funeral expenses be in the first place fully satisfied and paid out of my Estate; Item I give and bequeath unto my beloved wife Modelena Troxel one hundred and fifty pounds Current Money to be paid her by my Executors out of my Estate as soon as Possible after my Decease also the back room in the Stone part of the House to live therein during her life Together with her bed and bed clothes one Desk one Table six pewter plates four pewter Dishes two Iron pots one Copper Kettle also firewood as much as she will want to be cut and hauled to the House by my son Frederick Troxel and further my will is that each of my sons George and Frederick Troxel is to give unto my beloved wife Annually five Bushels of Wheat and three Bushels of Indian Corn also that she is to Have the Apples of one Row of my Apple Trees wherever she may choose During her life and the one half of the garden and a creature to ride when she pleases from my son Frederick Troxel also one Cow to be kept by my son Frederick for her use___ Item I give and bequeath to my beloved Son John Troxel five Shillings Current Money___ Item I give and bequeath unto my beloved daughter Barbara Martin five Shillings Current Money___Item I give and bequeath unto my beloved son Jacob one hundred pounds Current Money___Item I give and Devise unto my beloved son George Troxel the plantation next to John Crabs containing Two hundred acres of Land, on payment of Four hundred pounds to my Executors for the use of the Legatees herein mentioned in manner following Forty pounds at the Expiration of twelve months—after my Decease, Forty pounds at the end of two years after my Decease and so on Annually until the whole Sum be fully paid___ Item I give and Devise unto my beloved Son Frederick Troxel the plantation I now live on containing two hundred and Seven Acres of Land on payment of Four hundred__ hunded pounds Current Money to my Executors for the use of the Legatees herein mentioned in manner following Forty pounds at the expiration of twelve Month after my Decease Forty-- pounds at the end of two years and so on annually untill the whole Sum be fully paid. Item I give and Devise unto my beloved son Peter Troxel my House and Lot in Emmitsburgh also a lot of Ground near Emitsburgh containing Ten Acres of Land, also Two hundred pounds Current Money out of my Estate Item I give and bequeath unto my beloved Daughters Modlena Coon and Elisabeth Crise to each one Two hundred & fifty pounds Current Money out of my Estate, Item I give and Devise — unto my beloved Sons Jacob, Peter George and Frederick each one an equal part of my Mountain Land that I may Die Seized of to be by them Divided as they shall see cause And further my will is that my two Daughters Modelena Coon and Elisabeth Crise are to receive first each one Forty pounds Current Money, then my son Peter, to have Eighty pounds Current Money then my son Jacob to receive forty pounds Current Money then my Daughters to receive Each one forty pounds—Current Money that is Modlena Coon and Elisabeth Crise and so on as my Executors may Judge in this case untill the whole of the Legatees are paid and if any remainder of the Estate after the Legatees are paid and if any remainder of the Estate after the Legatees are paid to be given by my Executors to my beloved wife Modelena Troxall And Lastly I do hereby nominate constitute and appoint my Trusty and well beloved Sons Jacob Troxell and Peter Crise whole and Sole Executors of this my last will and Testament Disannulling and making void all other Former Wills and Testaments by me heretofore made confirming this and no other to be my last will and Testament In Witness whereof I have hereunto set my hand and Seal the day and Year first within written Signed Sealed Published and Declared by the above named P__t_r troxel (seal) Peter Troxel to be his last Will and Testament in the presence of us who have hereunto Subscribed our Names as Witnesses In the presence of the Testator Wm Emmit, F___nand Lays, Henrietta Emmit Frederick County February 7th 1799 Then came Jacob Troxell and Peter Crise and made Oath on the holy Evangels of Almighty God that the aforegoing Instrument of writing is the True and whole will and Testament of Peter Troxall late of Frederick County Deceased that hath come to his hand and possession Geo Murdock Regr. Frederick County Feby 7th 1799 Then came William Emmit and Ferdinand Lays two of the Subscribing Witnesses to the aforegoing last will and Testament of Peter Troxel late of Frederick County Deceased and made oath on the Holy Evangels of Almighty God that they Did see the Testator therein named sign and Seal this will and that they heard him Publish pronounce and Declare the same to be his last will and Testatment that at the time of his so doing he was to the best of their apprehensions of a sound and Disposing mind memory and understanding, that they respectively Subscribed their names as witnesses to this Will in the presence and at the request of the Testator and that they did also see Henrietta Emmit the other subscribing witness subscribe her name as a witness thereto in the presence and at the request of the Testator and all in the presence of each other.
