I Rhinehart Waltz of Frederick County in the State of Maryland, Farmer, being sick and weak in Body but of sound Mind, Memory and understanding thanks to Almighty God for the same and reflecting on the Certainty of Death and the uncertainty of the Time think it proper to make this my last Will and Testament for the Disposal of any worldly effects in the following manner to wit. Imprimis, it is my Will that my Funeral Charges and just Debts be first paid out of my Estate. Item. As I hold the Land whereon I live jointly with my Wife Remainder to her Heirs I do give and Bequeath the same to my said Wife Charity Waltz & her Heirs forever. Item. I give and bequeath unto my said Dear Wife Charity one Cow at her Choice and the Bed she lays on with the Furniture, also one pewter Bason, one pewtor Dish, two plates & half a dozen pewtor Spoons together with one Iron Dutch oven, one Iron Pott, one Iron Kettle and her Spinning Wheel. Item. I give and Bequeath unto my Son Peter Waltz one Shilling Sterling and no more of my Estate. Item I give and Bequeath unto my Son Peter Waltz’s two Children fifteen Shillings _____ each to be paid them by my Executrix when they respectively arrive at age . Item. Tis my Will and Desire that all the Grain with the Common growing, that is the small Grain on Hand & the Indian Corn should be Kept and used by my Executix for the support of herself & my Family that lives with me. Item all the rest & Residue of my Estate of what Nature of Kind soever I give and Bequeath unto my Dear Wife Charity Waltz & my following Children Viz Samuel, Michael, Dorothy, Rhinehart, John, Frederick, & Eve to be equally divided between them & their Heirs and assigns. Item It is my Will and Desire that my two Sons John & Frederick Waltz be carried to the Orphans Court at a proper Time and be bound to such Trades as they may repectively chose, and Lastley I do nominate and appoint my said Dear Wife Charity wholey sole Executrix of this my said Will, hereby revoking all former Wills by me made if any such there be Ratifying & confirming this only to be my last Will & Testament. In Witness whereof I have hereunto set my Hand and affixed my Seal this 17th Day of September in the year of our Lord 1782. George Murdoch Registrar Frederick County October 23, 1782 Then Came Peter Fine, John Albaugh & Fetrick Byer the three subscribing Witnesses to the aforegoing last Will and Testament of Rhinehart Waltz late of Frederick County deceased & severally made Oath on the holy Evangelist of Almight God that they did see the Testator therein named sign and seal this Will T that they heard him publish pronounce and declare the Same to be his last Will and Testament, that at the Time of his so doing he was to the best of their apprehensions of sound and disposing Mind Memory & understanding that they respectively subscribed their Names as Witnesses to the Will in the Presence and at the Request of the Testator & in the presence of each other.
