The submitter has given permission to the USGenWeb Archives to store the file permanently for free access. http://www.usgwarchives.net *********************************************************************** Last Will and Testament of David Wolfe Sr. In the name of God, amen, I David Wolf of Frederick County in the state of Maryland, being weak in body, but of sound and disposing mind, memory and understanding, considering the certainty of death, and the uncertainty of the time thereof, and beind desirous to settle my worldly affairs, and thereby be the better prepared to leave this world when it shall please God to call me hence do therefore make and publish this my last will and testament, in manner and form following; that is to say: First and principally, I commit my soul into the hands of Almighty God, and my body to the earth to be decently buried at the discretion of my executors herein after named, and after my debts and funeral charges are paid I devise and bequeath as follows: 1st Item. I give and bequeath unto my son Jacob Wolf in addition to what he has already received, the sum of one dollar, which shall be in full of his share of my estate both real and personal. 2nd Item. I give and bequeath unto my son Samuel Wolf the plantation whereon he now dwells, containing one hundred and twelve acres of land more or less, part of which being called Good luck and part addition to Good luck, to him the said Samuel Wolf his heirs and apyns forever, which shall be in full of his share of my estate both real and personal. 3rd Item. I give and bequeath unto my son David Wolf Jr. my plantation whereupon I now dwell, containing one hundred and sixty seven acres of land called Stony batter Enlarged, deeded to my by William Biggs Senr. on the 30th day of March 1830. Also four acres of timber land more or less, being part of a tract of land called Rackoons Walk lying on the north side of a certain stone fence extending from Solomon Forrests lint to Jeremiah Forrests line, in a direction nearly from west to east, said four acres also join said farm, to him the said David Wolf Jr. and his heirs and apigns forever, which shall be in full of his share of my seatate both real and personal. 4th Item. I give and bequeath unto my grandson Jacob Wolf Jr. the sum of fifty dollars. 5th Item. I give and bequeath unto my daughter Elizabeth who is intermarried with Solomon Forrest, about seventy acres of land more or less now in popepion of said Solomon Forrest, lying on each side of the publick road, above Andrew Drapers dwelling house, adjoining the lands of William Draper, Andrew Draper, Daniel Blikinstaff and Daniel Stottlemyer, it being part of a tract of land called The Range Around the Miserable Knobs. Also all hat piece or parcel of land lying between the piece or parcel of land on which the said Solomon Forrest now lives and a line running straight from the corner of Moses Hurley land nearest to said Solomon Forrests dwelling house, close past the lower side of the old blacksmithshop on the road below said Forrests to intersect Wilson Hays line, it also being part of the above named tract of land. Also one field containing five acres of land more or less, being part of a tract of land called Rackoonswalk, lying on the south side of the aforementioned stone fence, and adjoining the lands of the said Solomon Forrest and Jeremiah Forrest, to him the said Elizabeth Forrest and her heirs and apyns forever, which shall be in full of all her share of my estate both real and personal. 6th Item. I give and bequeath unto my daughter Susanna who is intermarried with John Stottlemyer, and to her heirs and apyns forever, all that piece and parcel of land, lying in Frederick county, being part of a tact of land called the Range around the Miserable knobs; and now occupied by a certain John Aryastein, adjoining the lands of Wilson Hays, Daniel Blickinstaff, Moses Hurley and running with the aforementioned straight line from the corner of Moses Hurley’ land nearest to Solomon Forrests dwelling house close past the lower side of the old blacksmithshop on the road below said Forrests to intersect Wilson Hays line. Also three hundred dollars to be paid to my said daughter Susanna as is herein after directed, which shall be in full of her share of my estate both real and personal. 7th Item. I give and bequeath unto my daughter Sarah Lewis all that part of a tract o land called Poplar Grove bought by me from a certain Jacob Ridenour for thirty and three quarter acres of land, lying in Frederick county, not for from where the heirs of Henry Wyant deceased now live. Also two hundred dollars to be put on interest in my executors, herein after named at their own risk; which into rest is to be paid to her yearly by them so long as she shall live, and after her death, the said tow hundred dollars, shall be divided between her children share and share alike to her said Sarah Lewis and her heirs and apigns forever, which shall be in full of her share of my estate both real and personal. 8th Item. I give and bequeath unto my daughter Catharine who is intermarried with Richard Crutcher, the sum of three hundred dollars, to be paid to her as herein after directed, which shall be in free of her share of my estate both real and personal. As I have sixty three and one half acres of land with improvements, which I bought of Yost Wyant, adjoining the lands of William Toms and others; and also twenty seven acres of land more or less, which I bought from Jacob Ridenour adjoining the ands of Abraham Toms Jr. and Samuel Toms and others, which I have not willed to any of my children, I therefore will and hereby order, direct and ordain that my executors shall sell the said sixty three and one half acres of land and also the said twenty seven acres together with all the personal property which I may have at my death, and out of the proceeds thereof and the money which I have out, after collected by them they shall pay the several sums herein before willed and bequeathed and the surplus shall be divided equall among between my children share and share alike. I do also hereby authorize and empower my Executors herein after named to execute deeds of conveyance to the purchasers of said land, which shall be as good and valid as if I had executed the same whith my own hands when living. And lastly I do hereby constitute and appoint my son David Wolf Jr. and Peter Rouse to be sole executors of this my last will and testament, revoking and annulling all former wills by me heretofore made, ratifying and confirming this and none other to be my last will and testament. In testimony whereof I have hereunto set my hand, and affirmed my seal this 20th day of August in the year of Lord one thousand and eight hundred and forty two. Signed, sealed published and declared by David Wolf the above named Testator, as and for his last will and testament, in the presence of us, who at his request, in his presence and in the presence of each other have subscribed our names as witnesses thereto. Henry Buhrman George Long William Toms Samuel Toms State of Maryland Frederick County to wit: On the 31st day of January 1846 came Henry Buhrman solemly sincerely and truly affirmed and declared that the foregiving instrument of writing is the true whole will and tstament of David Wolf late of Frederick County deceased that has come to his hands and _______ , that he received the same from the testator and that he does not know of any others. Test Thomas Sappington Reg. State of Maryland Frederick County to wit: On the 31st day of January 1846 came Henry Buhrmanand on the 2nd day of February 1846 came William Toms Samuel Toms three of the subscribing withesses to the foregoing last will and testament of David Wolf late of Frederick County deceased the first of whom solemly sincerely and truly affirmed and declared and the other two made each on the Holy Evangely of Almighty God, that they did see David Wolf the testator therein named sign and seal this will, that they heard him publish pronounce and declare the same o be his last will and testament That at the time of his so doing, he was to the best of their apprehensions of sound and disposing mind memory and understanding and that they respectively subscribed their names as witness to said will in the presence and at the request of the testator and that they did also see George Long the other subscribing witness sign his name as witness to said will at the request of the testator in his presence and all in the presence of eachother.
