All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/md/mdfiles.htm ************************************************ File contributed for use in USGenWeb Archives by: David Zimmerman zimmerman409@charter.net August 18, 2006, 8:22 pm Source: Family History Library Microfilm Written: June 15, 1793 FREDERICK COUNTY, MARYLAND WILLS MD – 11- 4 - 89 Liber GM No. 3 Folio 89 In The Name of God Amen I George Zimmerman of Frederick County and State of Maryland being old but in Good Health and considering the Uncertainty of this Life knowing that it is appointed for all men once to Die do make this my last will and Testament in manner and form following to wit First I give and bequeath my Body to the Dust from where it came and my Soul to Almighty god Beseeching his most Gracious acceptance of it Amen Blessed be God --- Item I give and bequeath unto my beloved Wife Catherine the use and benefit of that part of a Tract of Land called Hussianhart (?) containing Eighty Six acres whereon John Moore now lives during her natural life Also all the personal property which I may be possessed with at my decease / except to Bonds for the payment of Money / to have full privilege of the said personal property (except as before excepted / for and during her natural life never the less my will is that she shall not be accountable for any part thereof which she may be disposed to sell during her natural life and after her Decease my will is that whatever may be left of the personal property / she possesses / shall be sold by my Executors and the money arising therefrom to be Distributed as I shall hereafter Direct And Whereas I have heretofore Conveyed by Deeds / unto my Six Sons to wit George, Michael, John, Andrew, Nicholas and Benjamin certain portions or Mor’tgs of Land in the County Referenced to the Land records of this County being had will more fully appear, therefore do debar them from any other part of my Estate more than shall be hereafter Expressed Item I give and bequeath unto my Daughter Elisabeth One hundred and forty two pounds to be paid in Mannor following to wit Fifty pounds the first day of July Seventeen hundred and ninety four fifty pounds the first day of July Seventeen hundred and ninety Seven and forty two pounds the first day of July Seventeen hundred and Ninety Nine I give and bequeath unto my Daughter Catherine now wife to Peter Wolf Fifty eight pounds to be paid in the following manner fifty pounds the first day of July Seventeen hundred and Ninety seven Eight pounds the first day of July Seventeen hundred and Ninety nine I also give and bequeath unto my Daughter Catherines Children by her first Husband Henry Brammer (?) there being three Viz. Henry, John & Elisabeth the Sum of Twenty Nine pounds ten shillings to be equally Divided among them one year after the Decease of me and my Wife Catherine Item I give and bequeath unto my Daughter Mary Elizabeth now Wife of Elias Brunner the Sum of two hundred pounds to be paid in the following manner Viz. One hundred pounds the first day of July seventeen hundred and Ninety five Fifty pounds the first day of July seventeen hundred & Ninety eight, fifty pounds the first day of July Seventeen hundred and ninety nine – Item I give and bequeath unto my Daughter Susanna Wife Nicholas Holtz the sum of two hundred pounds to be paid in the following manner to wit one hundred pound the first day of July Seventeen hundred and Ninety Six, Fifty pounds the first day of July seventeen hundred and ninety eight twenty five pounds the first day of July Eighteen hundred twenty five pounds the first day of July Eighteen hundred and one – Item I give and bequeath unto the Children of my Daughter Peggy (who was Wife to Peter Bartell) the Sum of Fifty eight pounds eight shillings and five pence to be divided equally amongst them the Second year after the Decease of my self and my Wife Catherine Item I Further give and bequeath unto my Youngest Son Benjamin the sum of twenty five pounds to purchase a Horse and Cow – Item my will also is that the Land heretofore Divided to my Wife Catherine during her natural life Shall be the right and Estate of my Son John his heirs and assigns forever from and after the Decease of my Wife aforesaid on his paying the Sum of Two hundred and fifteen pounds for the same and that in two Annual payments after the Decease of my said Wife Catherine and in case of his making Default in payment for the Same at the above stated price and time my will in that case is that the said land Shall be Sold by my Executor hereafter named whom I hereby Impower to Convey and the Money arising from the Sale thereof as far as may be necessary applied in Discharge of the Legacy heretofore Devised Item my will also is that any part of my Estate not yet made mention of in this my Will and the Ballance that may be remaining in my Executors hands after the aforesaid Legacies – be paid Shall be Divided as follows Viz. my Sons George, Michael, John, Andrew, Nicholas & Benjamin one Share each my Daughters Elisabeth and Catherine one Share each my Daughters Peggys Children one Share amongst them my Daughter Mary Elisabeth and my Daughter Susannah one Share each my will also is that the money arising from the Sale of such of the personal property as may be left at the Decease of my Wife Catherine Shall also be Divided in shares in the manner Just above Stated – Lastly I nominate and appoint my two Sons George Zimmerman and Nicholas Zimmerman my whole and Sole Executors of this my last Will and Testament ratifying this and no Other In Testimony whereof I have hereunto set my hand and affixed my Seal this fifteenth day of June in the year of our Lord one Thousand seven hundred and ninety three Signed Sealed and Acknowledged by the Testator as his last Georg Zimmerman {seal} Will and Testament in presence of Lodowick Kemp Georg Yost Jacob Kemp Frederick county Nov’r 17th 1795 Then came George Zimmerman and Nicholas Zimmerman and made Oath that the aforegoing Instrument of writing is the true and whole Will and Testament of George Zimmerman late of Frederick County Dec. that hath come to their hand & possession and that they doth not know of any Other -- Geo Murdock Reg’r. Frederick County Nov’r 17th 1795 Then came Lodowick Kemp & George Yost two of the Subscribing Witnesses to the aforegoing last Will and Testament of George Zimmerman late of Frederick County Dec’d. and made Oath that they did see the Testator therein named Sign and Seal this Will that they heard him publish pronounce and declare the same to be his last Will and Testament that at the time of his so doing he was to the best of their apprehensions of a Sound and Disposing mind memory & understanding that they respectively Subscribed their hands as Witnesses to this Will in the presence and at the request of the Testator and that they did also see Jacob Kemp Sign his name as a Witness thereto in the presence and at the request of the Testator and all in the presence of each other 4 ½ sides Geo Murdock Reg’r.
