All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/md/mdfiles.htm ************************************************ File contributed for use in USGenWeb Archives by: Don Kelly the_lateman@yahoo.com January 8, 2009, 9:24 pm Source: Kent County Wills Written: August 24, 1881 Last Will & Testament of Thomas Kelley 1881 In the name of God Amen, I Thomas Kelley of Kent County, in the State of Maryland, being in feeble health of body, but of sound and disposing mind, memory and understanding, considering the certainty of death and the uncertainty of the time thereof and being desirous to settle my worldly affairs and thereby be the better prepared to leave this world when it shall please God to call me hence, do therefore make and publish this my last Will and Testament in manner and form following that is to say: First and principally I commit my soul into the hands of Almighty God and my body to be decently interred. Secondly -- After all my lawful debts are paid and discharged by my executor hereinafter named, I give, devise and bequeath to my son Close Decatur Kelley the farm upon which I now reside, together with the buildings, containing 33 acres, 3 Roods and 17 perches, during his natural life, then to his eldest son, provided however that my son Close D. Kelley shall provide for me good substancial food, good comfortable bedding, and take good care of me having my washing and mending done, and treating me with all the kindness due a father, again, my said son Close D. Kelley shall not permit anyone to live on the farm devised to him excepting his own immediate family and one boy to cull oysters during my life, again, when it shall please God to call me by death, my said son Close D. Kelley, shall have me decently buried with good head and foot stone, he paying all the expenses. Thirdly -- I also will and devise to my son Close D. Kelley all of my personal property and he the said Close D. Kelley to pay all the legacies hereinafter made. Fourthly -- It is my will and desire that should the son of Close D. Kelley die before reaching manhood then the farm devised to Close D. Kelley shall go to Thomas P. Kelley’s eldest son Francis Elmer Kelley. Fifth -- I give, devise and bequeath to my son John W. Kelley the House and Lot located in Skinner’s Neck during his natural life, then to his second son John Hero Kelley. Sixth -- I give, devise and bequeath to my sons James M. and Thomas P. Kelley the sum of one hundred dollars each. And to my son Theodore A. Kelley the sum of five dollars. Also to my four daughters, the sum of five dollars each. Namely, Mary Ann Sophia Kelley, Martha Elizabeth Kelley, Charlotte Kelley and Rebecca Matilda Kelley, and I hereby charge upon the real and personal property devised to my son Close D. Kelley the payment of all the above legacies. And Lastly -- I hereby constitute and appoint my son Close D. Kelley sole executor of this my last Will and Testament, hereby revoking and annulling all wills heretofore made by me. In testimony whereof I have hereunto subscribed my name and affixed my seal this twenty-fourth day of August A.D. 1881 - Eighteen Hundred and Eighty One. Diehl subscribing witnesses to the within and aforegoing Will, before me, and made oath on the Holy Evangels of Almighty God that they did see Thomas Kelley the testator therein named, sign and seal this Will, and that they heard him publish, pronounce and declare the same to be his last Will and Testament. At the time of so doing they believed him to possess a sound disposing mind, memory and understanding, and that they signed this will as witnesses, at the request and in the presence of the testator and in the presence of each other.
