All Rights Reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/md/mdfiles.htm ********************************************************* BENJAMIN LEITCH Leitch, Benjamin Sep 20 1803 Will Book T1, pp. 554[-555] A deposition was given by a Mrs. Elizabeth Oliver of Prince George Co, Md. stating that the heirs of Benjamin Leitch were Thomas Smith, Benjamin Leitch, Alexander Leitch, Isaac Ball and his wife Mary, Thomas Leitch, Benoni Truman and his wife Elizabeth and Draden W. Leitch. The heirs desire that the money and negroes be kept for schooling two youngest children(?) Date 20 Sept 1803. Copied from microfilm records in Prince George Co. (from the Prince George Gen. Soc.) In reviewing the microfilm of the wills, Benjamin Leitch died intestate, but in its place were two depositions. The depositions were of Thomas Leitch and Elizabeth Oliver and the two depositions were quite similar. They both testified that about four hours before his death, Benjamin Leitch had intended to put his wishes into writing, but did not have sufficient time to do so. So he orally stated that he wanted $50 of his estate applied towards the schooling of his two youngest children [stated as sons in the second deposition] and that he further wished that the two Negroes Ben and Nance be set aside and kept towards the support of his two youngest children until the youngest should be 12 years of age. (Herndon Papers) Singed the oath of fidelity and support 2 March 1778, as recorded in Brumbaugh and Hedges. Apparently went to Montgomery Co about 1755.Land records for Frederick Co(Later Montgomery) show that 28 Apr 1755 John Jones son of Evan sold to William Leach Sr., planter, for 20 pounds, 124 acres of the tract "William and John", together with all houses, outhouses, gardens, orchards and other improvements.(FC Deed E ,F.723) In 1759, he purchased land on the Muddy Branch in what is now Montgomery Co (FC Deeds F, f759) and in 1760 had a tract, "Leeches Lot" also on Muddy Branch, surveyed for patent (patent BC & GS # 17, f 331) Baptised at the Seneca Primitive Baptist church as an adult on April, 1777. Also some of his sons, Thomas, and John were baptised there. In 1763 he purchases from Clementious Davis, for 10 pounds, 16 acres of "Resurvey on Arpos." Mary Leach, widow of son John Leach-pt. of "William and John" son: Thomas Leach-pt of "William and John",pt of Resurvey of Orpus" son William Jr daus: Martha Fields, Nancy Leach ex: wife Martha Listed in DAR Patriot Index-Centennial Edition part 2 pg 1763 William Sr: b 1718,wife, Martha,d.1783 Md WILLIAM LEACH JR: 1785 Deed from William Leach to Benjamin Ray An indenture was made April 1, 1785 and recorded May 20, 1785 between William Leach, seller, and Benjamin Ray, buyer, for several parcels of land.[39] The land and principals were all in Montgomery County, Maryland. Sale price was fourteen pounds current money. The tracts were "two acres and one half acre of Land part of the resurvey on Leaches Lott, seven acres part of Coles Chance and four acres and one quarter acre part of the Resurvey on Mitchells Range.containing thirteen acres and three quarters of an acre of Land" This thirteen and three quarters of an acre are part of a "Tract of Land called Leaches Lott, Originally on the eight(sic) Day of October one thousand and seven Hundred & Sixty, granted to William Leach for twenty five acres, and running thence north Eleven Degrees West one Hundred and Sixty five perches, North eighty eigh(sic) Degrees West fourteen Perches and one half perch, to a stone planted In at (sic) alley with the Letters BR on the east Side of said Stone, then South eleaven(sic) Degrees east one Hundred and Sixty eight perches and one half perch, to another planted Stone with the letters WL, on the west side of Said Stone, then to the first Beginning and now laid out for thirteen acres and three quarters of an acre of land more or less" Joseph Wilson and George Beall were witnesses. "At the same day came Mary the wife of the said William Leach" and relinquished her "Right of Dower"
