(Information provided by the Court) "In the Name of God Amen January the twenty sixth Day in the year of our Lord one thousand seven hundred and sixty six I Daniel Viers Senior of Frederick County in the Province of Maryland Plantor being of a sound and perfect mind, memory and understanding, thanks be to the Almighty God for the same, but considering the frailties of this transitory life that all things are uncertain, I do make nominate publish & declare this as and for my Last Will and Testament hereby revoking all former and other Wills and Testament by me heretofore made ratifying this my Last Will and Testament only in manner & form following that is to say, first, I give and bequeath my Soul into the Hands of the Almighty God who gave it me & my Body to the Earth from whence it was taken to be secondly intered with as little Pomp as possible, and as for all that worldly Estate wherein this has pleased God to endow me with, I dispose thereof in the manner & Form following: First I give bequeath unto my loving Wife during the Term of her natural Life and in Lieu of her thirds in all the Rest of my Estate both real and personal, all that tract or parcel of Land called None Eaton lying and being in Frederick County aforesaid containing one hundred and nine acres more or less and after her decease my Will is that same be equally divided between my Sons John and William, to them, their heirs and assigns forever. Likewise I give & bequeath unto my Son Daniel forty Acres of Land out of the Resurvey on Rum Punch adjoining to the Plantation whereon he now lives & to his Heirs and assigns forever ___. I give and bequeath unto my Son Nehemiah, his heirs and assigns forever, fifty acres of Land being part of the Resurvey in Dublin, the plantation whereon he now resides. ____ I will that the plantation whereon I now reside called Rum Punch together with ten acres out of the Resurvey called Dublin lying on the West Side of Rum Punch aforesaid and also forty six acres of Land out of the Resurvey on Rumpunch lying on the East South East part of Rum punch aforesaid including in the whole one hundred and sixteen acres of Land so soon as convenientby may be after my Decease be sold to the highest Bidder by my Executor hereafter named, as also all my Servants and Stock of what Nature and kind soever & all my Plantation utensils, houshold Furniture of what Nature and Kind soever in or belonging to the said Lands and premises and all my just Debts paid out of the Will proceeds arising therefrom and if any overplus remain after payment of my just Debts as aforesaid I will that the same be equally divided betwixt my Daughter Anna & Elizabeth. Lastly I nominate and appoint my Son Daniel sole Executor of this my Last Will and Testament. In Witness whereof I have hereunto set my hand & Seal. The Day and year above written. Pigman, William Cahill On the 16th day of October 1766 same Lerrat Dickason, Nathan Pigman and William Cahill, the three subscribing Witnesses to the foregoing Will and made oath on the holy Evangelists of Almighty God that they did see the Testator, Daniel Viers sign and seal the said Will and heard him publish, pronounce and declare the same to be his Last Will and Testament, and that at the Time of his so doing he was to the best of their apprehension of a sound & disposing mind & memory, and that they severally subscribed their Names as Witnesses to the said Will in the presence of the said Testator & in the presence of each other.
