All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/md/mdfiles.htm ************************************************ File contributed for use in USGenWeb Archives by Barbara Westerfield Hilyerd LAST WILL AND TESTAMENT OF WEAVER BARNES In the name of God, Amen: I, Weaver Barnes, of Montgomery county, of the state of Maryland, being weak and sick of body, but of sound and perfect mind and memory, and considering the uncertainty that all flesh must yield unto death when it shall please God to call; do make publish and declare this my last will, and testament in manner and form following: First-I give and bequeath unto my well beloved son, Thomas Barnes and the heirs of his body lawfully begotten forever one hundred and fifty acres of land, where on my son Richard Weaver Barnes now dwells, called Inspection. But should my son Thomas Barnes die without issue it is my will that the foresaid piece of land called Inspection be sold at publick (sic)value and the money arising from the sales there of be equally divided amongst all my children then living shear (sic) and shear (sic) alike Also I give to my said son Thomas Barnes my wearing apparel. Also I give to my said son Thomas Barnes one young black horse and my riding saddle. I also give and bequeath unto my beloved son Richard Weaver Barnes and his heirs and assigns forever two hundred acres of land being part of a tract of land called "The Second Addition to Snowdens Manner " Also I give to my said son Richard Weaver Barnes and his heirs and assigns forever, after the decease of my wife Elizabeth Barnes my dwelling plantation whereon I now dwell being part of a piece or parcel of land called "Snowdens Addition to His Manner" Also I give unto my said son Richard Weaver Barnes one negro woman called Gomer and her child Cate. I also give and bequeath unto my grandson Richard Weaver Johns, one negro boy called Lousbrey. I also give and bequeath unto my grand-daughter, Ann Johns, one negro girl called Venus I also give and bequeath unto my beloved son Joseph Barnes during his natural life one negro girl called Nell and after the decease of my said son Joseph Barnes, I give the aforesaid negro girl called Nell and increase if any she hath unto my grandson Weaver Barnes son of Joseph Barnes. I also give and bequeath unto my beloved daughter Dorcas Hocker, during her natural life, one negro girl called Cloe and after the decease of my said daughter Dorcas Hocker, I give the foresaid negro girl called Cloe and the increase if any she hath to my grandson Weaver Hocker, son of Phillip Hocker. I also give and bequeath unto my dear and beloved wife Elizabeth Barnes, during her natural life my dwelling plantation whereon I now dwell. Also I give to my foresaid wife Elizabeth Barnes during her natural life the following negroes --Viz: Mingo, Adam, Viney and Dinah and after her decease my will is that they and their increase if any they have be divided between my granddaughter Ann Johns and such of my children as may then be living. As for the remaining part of my Estates after my lawful debts is paid my will and desire is that it be equally divided between all my children then living and my granddaughter Ann Johns shear (sic) and shear (sic) alike. In witness I have here unto set my hand and affixed my seal this twelfth day of January, in the year of our Lord 1781. (his) Weaver B. Burgess John Farrell Archibald Mason Montgomery county, February 27, 1781, then came Joseph Barnes and Richard Weaver Barnes and made oath on the Holy Evangels' of Almighty God that the within instrument of writing is the true and whole will and testament of Weaver Barnes late of said county deceased, that has come to these hands of possession and that they doth both not know of any other. Certified by Samuel Turner Registrar And same day came John Farrell and Archibald Mason two of the subscribing witnesses to the within last will and testament of Weaver Barnes late of said county deceased and severally made oath on the Holy Evangels of Almighty God that they did see testator therein named sign and seal this will and that they heard him publish pronounce and declare the same to be his last will and testament, that at the time of his so doing he was to the best of their apprehension of sound and disposing mind, memory and understanding and that they and Edw. Burgess and the other subscribing witness respectfully subscribed their names as witnesses to his will in the presence and at the request of the testator and in the presence of each other. Certified by Samuel Turner Registrar I hereby certify that the above is a true copy of the will of Weaver Barnes as recorded in Liber.
