T, f. 148-150 At the request of William Beckwith, George Beckwith & Basil Beckwith the following deed was recorded July the thirty first day Anno Dmi Seventeen hundred & thirty four. This Indenture made the twenty third day of July in the twentyeth year of the Dominion of the Honourable the Lord Proprietary & in the year of our Lord one thousand seven hundred & thirty four Between Clement Hill of prince Georges County Gent. of the one part & William Beckwith, George Beckwith & Basil Beckwith of the County afsd Gent of the other part Whereas John Miller of the County afsd Gent by his dcs? Indented bearing date the twelfth day of July in the year afsd for the considerations therein mentioned hath conveyed & made over to the said Clement Hill all his real & personal Estate Now this Indenture Witnesseth that the said Clement for the considerations hereafter in these presents & proof & for the Jud? & true performances of the covenants herein mentioned & for divers other causes & considerations ___ thereunto Especially moving hath given granted bargained & sold as by these presents and the said Clement Hill hath given grant bargain & sell unto them the said William Beckwith, George Beckwith & Basil Beckwith for the uses intended & purposes herein after & professed (that is to say) all that tract or parcel of Land called Morefields containing by Estimate one hundred & fifty acres, part of a tract of Land called Four Hills containing twenty seven acres a tract or parcel of Land called Berry’s Fortune part of Four Hills containing two hundred & sixty seven acres, part of a tract of Land called ?Pottomick? containing thirty five acres except a___ will & four acres of Land thereunto belonging all which said tracts or parcels of Land are lying & being in prince Georges County afsd & the following negroes viz Jone Harry Kate & her daughter Sue & one fifth part of all the sheep, hoggs, horses, mares, plate, household stuff corn goods money either in England or also where & all other the personal estate of what nature or kind Soever which the said John Miller hath made over to the said Clement Hill together with & all Singular the improvements & conveniencys & advantages to the said Several tracts or parcels of Land belong or in any ?wise appertaining & except the will of four acres of Land before accepted To Have and to hold the several tracts or parcels of Land afsd (except before excepted) unto the said William Beckwith, George Beckwith & Basil Beckwith to the uses intents & purposes afsd all (that is to say) to the use of the said Ann Miller wife of the said John Miller her exctr adms or assigns & to no other use intent or purpose whatsoever & the said Clement Hill doth for himself his heirs Exctr & adm covenant promise grant & agree to & with the said William George & Basil Beckwith their Exctr & adm the several tracts & parcels of Land afsd to the said William George & Basil Beckwith to the uses intents & purposes afsd for & during the natural life of the said Ann Miller afsd from against him the said Clement Hill his heirs & assigns & from & against John Miller his heirs & assigns & from & against all persons claiming or to claim from by or under him or them & all & Singular the four negroes afsd & one fifth of the cattle, sheep, hoggs, horses, mares, plate household Stuff corn goods money in England or also where & all other personal estate as afsd against him the said Clement Hill his Exct & adm & all claiming or to claim from by or under him shall & will warrant & defend by these presents & the said Clement Hill doth for himself his heirs Exctr & adm covenant promise & agree to & with the said William, George, & Basil Beckwith that the said Clement Hill shall & will render a just & true account of all the personal estate made by the said John Miller as afsd that are in the house lodge & possession of the said Clement Hill or that hereafter shall come to his knowledge or possession in order to ?vest? the said William George & Basil Beckwith for the use afsd with one fifth part of the said John Miller’s personal estate so made over as afsd & that if any of the four negroes afsd or any part of the personal estate afsd shall not be the right property of the said Clement Hill by virtue of the said John Miller’s deed to him as afsd that he the said Clement Hill shall make good to the said William George & Basil Beckwith for the uses afsd four parts in five & one half of the charge of any Law Suit concerning the same & the said Clement Hill Doth for himself his heirs Exctr & adm covenant promise grant & agree to & with the said William George & Basil Beckwith that the said John Miller his heirs Exctr or adm or any other person or persons by his assent means or procurement shall not at any time or times hereafter by any ways or means whatsoever either directly or indirectly ?molest? challenge or make any title claim or demand to or for the said John Miller or to or for the Several tracts or parcels of Land afsd or to for the four negro’s afsd & one fifth part of the cattle, sheep, hoggs, horses, mares, plate household stuff corn goods money & personal estate afsd or any other thing whatsoever that she the said Anne Miller or any other person for her or to her use by virtue of these presents or at any time hereafter shall have or be in possession of & the said William Beckwith George Beckwith & Basil Beckwith do for themselves & each of them their & each of their Exctr & adm covenant promise grant & agree to & with the said Clement Hill his heirs & assigns that she the said Anne Miller during her natural life shall not cut down trees of any sort clear or make use of more than one third part of the wood land belonging to the Lands afsd which is to be divided by lotts except lumber trees for shingles to shingle the dwelling house if there is not sufficient timber upon the said one third part to be assigned the said Ann Miller as afsd & the said William George Basil do for themselves their Exctr & adm hereby further covenant promise grant & agree to & with the said Clement Hill that she the said Ann Miller shall during her natural life pay the rent due unto the right Honourable the Lord proprietary for the said tracts or parcels of Land afsd & the said Clement Hill that the said Ann Miller shall & will render a just & true account of all the said John Miller’s personal estate that is in the knowledge & possession of the said Ann Miller or that hereafter shall come to her knowledge or possession & that if any just debt or debts hereafter shall appear against the said John Miller & be paid by the said Clement Hill the said Ann Miller shall refund & pay to the said Clement Hill his Exctr or adm one fifth part hereof & that if any part of the said John Miller’s estate made over to the said Clement Hill at the time of making the same over was not the right & property of the said John Miller that the said Ann Miller shall make good & pay one fifth part to the said Clement Hill his Exctr & adm & the said William George & Basil Beckwith do for themselves their & each of their Exctr & adm further covenant promise grant & agree to & with the said Clement Hill his Exctr & adm that the said Ann Miller her Exctr or adm or any other person or persons by her assent means or procurement shall not at any time or times hereafter by any ways or means whatsoever either directly or indirectly molest challenge nor make any title claim intermeddling or demand to or for the said Ann Miller to or for any Dower of any Lands which she might or ought ot have by the death of the said John Miller or to or for any negroes goods implements household stuff or any other thing whatsoever made over by the said Miller to the said Clement Hill as afsd neither ask demand or recover afsd or against the said John Miller any manner of alimony allowance or other thing whatsoever for or towards the Diet meal Drink apparel Sustenance or Lodging of the said Ann Miller In Testimony whereof the party to these presents have interchangeably set their hands & affixed their seals the Day & year first above written Clement Hill (seal) Signed Sealed & Delivered William Beckwith (seal) In presence of George Beckwith (seal) Jacob Henderson Basil Beckwith (seal) Tho: Clark & On the back of which Deed was this Endorsed July the 23.1734 Then came Clement Hill before us the subscribers tow of his Lordship’s Justices of the peace for prince George’s County & acknowledged the within deed according to act afsd assembly in such cases made & Provided before us Dan: Cranford July 31 1734 Tho: Clagett Then recd of Mr Basil Beckwith nineteen shillings & three pence being for alienation of the within written deed conveyed & made over by Mr Clement Hill ?__?
