I Francis Beall of Prince Georges County in the State of Maryland being in infirm health of body but of Sound and disposing memory and understanding, aware of the certainty of death and that the period of its approach is hidden from our eyes, desirous of settling all my worldly affairs and preparing for the ____ transition from here to eternity when it shall please our Heavenly father to summon me home, I therefore make and publish this my last Will and Testament in manners following that is to say First I resign my soul to my all Gracious Creator who fashioned it with all humble reliance on his Mercy and forgiveness of all my sins and transgressions through the merits and atonement of our blessed Redeemer and I commit my body to the earth to be suitably intered under the direction and at the discretion of my Executor hereinafter named and appointed, and after my funeral expenses and my just debts are paid, I devise and bequeath as follows. I give and bequeath to my son William one hundred and fifty dollars to be paid to him by my Executor hereinafter named and appointed, on his arrival at the age of twenty one years. Item I give and bequeath to my son Washington Francis one hundred and fifty dollars to be paid to him by my Executor on his arrival at the age of twenty one years. Item I give and bequeath to my beloved wife all the rest and residue of my Estate during her natural life or widowhood and after her decease or marrying which ever may first take place, my will and desire is that the whole of my Estate devised to my wife that remains after her decease or marriage shall be sold to the best advantage and the proceeds of such sale to be divided between my nine children viz James, Thomas, John, Alpheus, Shadrack, David, Elijah, William and Washington Francis in equal proportion share and share alike. Item and Lastly I do hereby constitute and appoint my son Thomas Beall Executor of this my last Will and Testament revoking and annulling all former wills and confirming this and none other to be my last will and testament. With my hand and seal this seventeenth day of December in the year of our Lord one thousand Eight hundred and thirty nine. Signed, sealed, published and declared by Francis Beall. Testator in the presence of us the undersigned who in his presence at his request and in the presence of each other, subscribed our names as witnesses thereto. Signed Thomas C. D______, Joseph J. Jones Whereas I Francis Beall, Testator of Prince Georges County have made and duly Executed my last Will and testament in writing bearing date the seventeenth day of December in the year one thousand Eight hundred and thirty nine, which said last will and testament and every clause and bequest and devise therein contained I do hereby ratify and confirm, saving and excepting the clause therein contained which authorises the sale of the whole of my Estate devised to my beloved wife during her life or widowhood, without making any provision for the release of certain negro slaves herein after named viz Henrietta Beanter, Martha Jane, George Wesley and James Madison. Now it is my will and desire that the said Henrietta Beanter, Martha Jane, George Wesley and James Madison as they arrive at the age of thirty two years respectively shall be liberated and forever set free from slavery and it is further my will and desire that the issue born of the said Henrietta Beanter and Martha Jane during their servitude shall as they respectively arrive at the age of thirty two years be also liberated and forever set free from slavery. And I do hereby make this my Codicil which I will and direct shall be taken and held as part of my said will and testament. In testimony whereof I have hereunto set my hand and affix my seal this thirty first day August in the year of our Lord one thousand and forty.
