The submitter has given permission to the USGenWeb Archives to store the file permanently for free access. http://www.usgwarchives.net *********************************************************************** Following is a transcript of the will of Richard Marsham Maryland Wills Liber 13, folio 514-520 In the name of God Amen I, Richard Marsham of Prince Georges County, being farstricken in years and considering my life on earth cannot be long yet of perfect mind and understanding do make and appoint this my Last and Testament in manner and forme following hereby revoking, disanuling and makeing void all other will or wills by me heretofore made and appointed. Imp -- I commend my soule in to the hands of Almighty God who gave it hopeing through the merrits death and passion of my Saviour Jesus Christ to have a full pardon of all my sins and to inherit eternal life and my body to the earth from whence it was taken to be buried at the discretion of my Exs. hereafter named and appointed and for what estate it hath pleased Almighty to bestow upon mee I dispose of as followeth: Item -- I give and bequeath unto my grandson Basill Waring two tracts of land, one called Strife or Troublesom, containing 335 acres and the other tract of land called Children's Loss, bought of Mr. Clemt. Grook containing 240 acres, the said two tracts of land to the said Basill Waring for and dureing his naturall life, and after his decease to Thomas Waring son of the said Basill Waring to him and the heirs of his body lawfully begotten for ever and for want of such heirs to the next in blood of said Basill Waring's children & their heirs for ever, but in case Martha Waring wife to ye said Basill Waring should outlive ye said Basill, that these she to have ye said lands during her widowhood. Item -- I give and bequeath to my grandson Basill Waring one negrow man called Charles bought and paid for by me and by me delivered into the hands of my daughter Sarah Waring when a widow, by her to be delivered to the said Basill, which said negrow is now in the possession of Mr. James Haddock and to be delivered to the said Basill whenever required or demanded. Item -- I give and bequeath to Thomas Waring son of said Basill Waring one silver spoone. Item -- I give and bequeath to Thomas Waring son of said Basill Waring one negro man called Young Dick Shore to be delivered to him within seaven years after my decease. Item -- I give and bequeath to my grandson Leonard Brooke three tracts of land vizt, the one called Black Wallnut Thicket containing 300 acres, and one tract more called Content containing 300 acres and one tract of land more called St. Katherines containing about 50 acres, the said lands lying in the passes (falles?) of Patuxent River, the said three tracts of land to the said Leonard Brook and the heirs of his body lawfully begotten for ever, and for want of such to the heirs of Marsham Waring. Item -- I give and bequeath to my grandson Leonard Brooke five negrows named Pompsy, Quassy, Prince, Great Pegg and her son Robin and their increase for ever as also fourtee head of cattle (young and old), twelve head of sheep and twelve head of hoggs, to be delivered him when he shall arrive to the age of 20 years. Item -- I give and bequeath my sd. grandson Leonard Brooke the best feather bed and furniture in my house except that in my porch chamber with two par of sheets, two table cloaths, six napkins, four putor dishes that were his fathers, one Large Iron pot, one Iron Kettle, one small table, two turkey work chares, and six leather chares, to be delivered at ye age of 20 years as aforesd. Item -- Notwithstanding I have above given to my grandson Leonard Brooks these severall tracts of land my meaning is that they shall be and remain in the possession of my Executor for five year after the said Leonard Brooke shall come to full age and not longer at which time I give & bequeath to ye said Leonard Brook half ye stock of hoggs and cattle belongin to ye plantation whereon my negrow Pompey liveth as also one halfe of the household goods belonging to said quartor and at the same time my Ex. to pay him one indefor? feather bed and furniture more. Item -- I give and bequeath to my sd. grandson Leonard Brooke one negrow man called Young Charles to be delivered to him when the crop is finished that is pickt at the time of my decease. Item -- I give and bequeath to my said grandson Leonard Brooke two silver spoones. Item -- I give and bequeath unto my grandson Samuel Queen two negrows named Sambo and his wife Dido. Item -- I give and bequeath to my grandson Marsham Queen two negrows named Marke, and the other Samuel. Item -- I give and bequeath to my grandson William Queen two negrows named Young Mingo and the other Herculeas. Item -- I give and bequeath to my grand-daughter Catherine Queen two young negrows named John and the other Jane. Item -- I give and bequeath to my grand-daughter Margaret Queen two negrows named Young James and Mary. Item -- I give and bequeath to my five grandchildren last mentioned named Samuel Queen, Marsham Queen, Wiliam Queen, Catherine Queen and Margret Queen to each of them six head of cattle young and old, five head of sheep, two breeding sows, one Iron pott to contain about six gallons, one frying pan, one Iron pestel and two small puter dishes. Item -- I give and bequeath to my said grandchildren Samuel Queen, Marsham Queen, Wiliam Queen, Catherine Queen and Margret Queen one tract fo land called Inclosure which I lately bought of Col. Ninian Beale containing by pattent one thousand forty acres to be divided as followeth, vizt. to Samuel Queen 240 acres, and to Marsham Queen 200 acres, to William Queen 200 acres, to Catherine Queen 200 acres, to Margret Queen 200 acres, but if any of the last mentioned grandchildren should decease before they arrive to the age of 21 years or the two female maryed that their part to be equally divided amongst ye sorvivors, and that if the said 1040 acres should containe more or less the division to be made prato to them and the heirs of their body for ever. Item -- I give and bequeath to my grand-daughter Ann Bournman one negrow called young Bess to be delivered to her at the same time when Leonard Brook hath Charles delivered to him. Item -- I give and bequeath to my daughter Sarah Haddock one gold Ring of 20 shillings prise. Item -- I give unto the Reverend James Haddock five pounds sterling. Item -- I give and bequeath to my kinsman Will Murdock the son of Mr. John Murdock one silver spoone. Item -- I give and bequeath to Basill Waring the son of Marsham Waring one negrow man named Will. Item -- I give and bequeath unto Sarah Waring the daughter of Marsham Waring one mollatto woman slave named Sarah and her increase forever. Item -- I give and bequeath to John Osbourn one tract of land called Trundle Bed Cuckold(?!) ye said land to the said Osburne and the heirs of his body lawfully begotten for ever and for want of such heirs to the heirs of Marsham Waring. Item -- I give and bequeath to the said John Osbourne two young heifers and two young breeding sows. Item -- I give and bequeath to my grandson Marsham Waring four tracts of land one called Mount Pleasant containing 400 acres, and one tract called the Exchanges and all the remaining part of a tract of land called Marshams Rest containing about 300 acres, together with one tract of land called the Barron Point containing about 50 acres, the said fourt tracts of land to the said Marsham Waring for and during his natural life and then wholy to redound to Richard Marsham Waring son of the said Marsham Waring and the heirs of his body lawfully begotten for ever and for want of such to the next heir in blood of Marsham Warings children, but in case that ?? the wife of Marsham Waring should outlive her husband that then during her widowhood to live quietly upon the said land be. Item -- My will and pleasure is that my negro woman Sarah and her two daughters Beck and Sarah be and remain upon my now dwelling plantation to cair and mend and make for so many of my grandchildren as shall dwell thereon, and I do hereby appoint and order that my Executor do find and allow to my said negrow woman Sarah good sufficient dyet and apparill and to pay her yearly and every year during her natural life the sum of two pounds sterling provided she prove true and faithfull to my Executor. Item -- I give and bequeath to Richd. Marsham Waring one feather bed and furniture. Item -- I will that my slave named Robert (a mollatto) to serve my Executor until he shall arive to the age of 35 years, his age now being accounted 28 years, and then the said Robert and his Wife and Childe which he now hath to be fully discharged and set free provided they be vigilent and faithfull to my Executor during the time theirof servitude, but in case they have other children that those other children continue slaves to my Executor. Item -- I will that my molatto slave named James serve my Executor untill he arive to the age of 35 years & then to be fully discharged and set free, his age being now accounted seaventeen years, provided he prove vigilant & faithfull to my Executor during ye time of his servitude. Item -- My will and pleasure is that if any one or more of my grandchildren shall herafter indeavour to sue, trouble or molest my Executor (hereafter mentioned) claming anything in law of their deceased father's estate, that then such one or more of my said granchildren to have no benifitts of this my last will and testament, but his or their parts wholly to redound to my said Executor. Item -- My will and pleasure is that all the remainder part of my estate not bequeathed in this my last will and testament be and continue as it now doth untill such time that my five granchildren (to say the five children of Mr. Samuel Queen deceast) have sufficient education, but the benifit of their work to be disbursed for ye maintenance of my said five grandchildren at the discression of my Executor and Trustees hereafter named & appointed and then to redound to my said Executor and his heirs for ever. Item -- I give and bequeath to Mr. Clement Brooke one gold ring of 20 shillings prise. Item -- I give and bequeath to Mr. William Joseph one gold ring of 20 shillings prise. Item -- I do hereby nominated and appoint my well-beloved friends Mr. William Joseph, Coll. Thomas Greenfield, and Mr. Clement Brooke to be overseers in Trust to see this my last will and testament faithfully Executed, and my said Executors shall do nothing as to paying of debts and legacies or ending any disputes amongst my said granchildren without first consulting my said Trustees or the major part of them, and My Executor shall stand to and abide the judgement and determination of my said trustees or the major part of them and what charges the said trustees shall be at shall be discharged by my said Executor out of my estate, and that no other construction be put upon this my last will and testament at to matter of substance but all to be understood according to the true intent and meaning and sence of ye words as they lye. Item -- I ordain, constitute and appoint my well beloved grandson Marsham Waring whole and sole Executor of this my Last Will and Testament. Item -- I give and bequeath to my grandson Richard Brooke one negrow named Charles (the son of Mingo) and I ord. that the said negrow be delivered him after ye finishing of the crop sown or growing at th etime of my decease, and order that the negro bqueathed to Ann Bourman be delivered her at the same time and that in case that Coll. Greenfield should decease that Capt. Thos. Truman Greenfield I do appoint in his stead. Item -- I will that when my grandson Leonard Brooke shall arise to the age of 20 years, that my slave mollato Robert build him one twenty foot dwelling house and one fifty foot tobacco house clear of carpenters wages together with one fifteen foot quarter. Item -- I will that my grandson Leonard Brooke continue at my now dwelling plantation and have his maintenance of my Executor untill he arive to the age of 20 years, and then be paid five pounds sterling to purchase nailes. Item -- I give and bequeath to my five grandchildren (to say) the five children of Mr. Samuel Queen, to each of them a feather bed and furniture, in witness whereof I have hereunto set and put my hand and seal this 14th day of Aprill Annoque Domini 1713. witnessed by Tho.
