All Rights Reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/md/mdfiles.htm ********************************************************* Indenture between William Elliott Griffith (Griffeth) and George Downes Queen Anns County, Maryland 1790 This indenture made and concluded the twenty seventh day of July in the year of our Lord Christ one thousand seven hundred and ninety between William Elliott Griffeth of Queen Anns County the state of Maryland farmer of the one part and George Downes of the same county and state farmer of the other part, witnisseth that the said William Elliott Griffeth for and in consideration of the sum of two hundred and twenty five pounds current money to him in hand paid by the said George Downes the receipt where of the said William Elliott Griffeth doth hereby acknoledge he, the said William Elliott Griffeth, hath granted, bargained, sold, aliened and confirmed by there presents doth grant, bargain and sell alien and confirm unto the said George Downes his hiers and assignes forever all that tract or parcel of land lying and being in Queen Anns County afor’d known by the name of Welch Pool Addition and with in the following times to wit beginning for the part hereby bargained and sold at the stone standing by the road side that leads from Tuckahoe Bridge towards Tullys neck on the north side of said road in or near to a line of Anthony Harrington’s land marked with figure one, and running thence north forty three degrees west to another marked stone with two the distance of sixteen perches, then north fifty five degrees and forty five minutes east ten perches to another stone marked with figure three, then south forty three degrees east sixteen pirches to another stone by the road side market with figure four, and from thence with straight line to the place of begining containing and now laid for one ___ more or less together with all and singular the houses, out houses, gardens,orchards, fences, woods, under wood, ways and watters - and water courses and all other the priveledges and advantages unto the same parcel of land belonging or in any wise appurtaining and the reversion and revisions, remainder and remainders, rents, issues, services thereof, and all the estate right, title, entrust of him the said William Elliott Griffeth of in to or out of the same, either in law or equity, to have and to hold, the hereby bargained and sold lands and premises with the appurtenances to the same belonging unto the said GeorgeDownes, his heirs and assigns to the only proper use, benefit, behoofe of him the said GeorgeDownes, his heirs and assigns for ever and the said William Elliott Griffeth doth for himself and his heirs hereby covenant, grant and agree to and with said George Downes his heirs and assigns that he, the said William Elliott Griffeth and his heirs, the afods (aforesaid?) parcel of land and every part thereof unto the said George Downes his heirs and assigns against himself and his heirs and other his assigns and also against all manner of persons or persons whatsoever shall and will warrant and by these presents for ever defend. In testimony where of the parties to these presents have hereunto interchangealbe set there hands and seals this day and year first before written. Wm Elliott Griffith (seal) Sealed and Delivered In the presence of us Geo Baynard, Henry _____ Received this 27th day of July 1790 from George Downes in the within deed named the sum of two hundred and twenty five pounds current money, in full, for the consideration mentioned in the within deed as witness my hand - Wm Elliott Griffith Test Geo Baynard, Henry ____ Queen Anns County: Be it remembered that on the 27th day of July anno domini seventeen hundred and ninety personally appeared before as the subscribers two of the Justices of the Peace for the county aforesaid, William Elliott Griffeth in the within deed named and Margret his wife and did severally acknowledge within deed and the lands or land and premises therein mentioned unto George Downes in the same deed named his heirs and assigns to the only proper use and behoof of the said George Downes his heirs and assigns for ever according to the form force and effect of the same and the ___ of assembly in such case made and provided the said Margret, having been first by us privately examined out of the hearing of her said husband, who declared that she made her acknowledgement aforesaid willingly and freely without being induced thereto by threats or ill usage by her said husband or fear of his displeasure. Let it be remembered "Griffeth" & the word "the" was enterliened between the second and third line before the sealing and delivering of the deed. Geo.
