All Rights Reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/md/mdfiles.htm ********************************************************* Indenture between Matthew Garrett and Mary his wife and Charles Downes Queen Anns County, 1787 This Indenture made the fifth day of March Seventeen Hundred and Eighty Seven Between Matthew Garrett and Mary his wife of Queen Anns County in the State of Maryland, taylor of one part, and Charles Downes of the county and state aforesaid, carpenter and joiner, of the other part witnesseth that the said Matthew Garrett and Mary his wife, for and in consideration of the sum of one hundred and twenty pounds current money of Maryland to them in hand paid by the said Charles Downes the receipt where of the said Matthew Garrett doth hereby acknowledge and confess himself to be there with fully satisfyed contented and paid, hath granted, bargained, sold, aliened, enfeofed, released and confirmed unto the said Charles Downes his Heirs and assigns forever Part of a tract of land called Anns Portion Enlarged, lying and being in Queen Anns County, begining at the south easternmost corner of said tract and running up the main road north west fifty perches the north fifty seven degrees east sixty foure perches and a half then south twenty degrees ten minutes east twenty four perches to the last line of said land called Anns Portion Enlarged, then with the said last line reversed to the place of begining, containing and now laid out for thirteen acres, more or less, together with all houses, buildings, orchards, gardens, fences, trees, woods, underwoods, ways, waters, advantages, emotuments and hereditaments ,whatsoever, to the said land belonging or in any wise appertaining, and also the reversion and reversions remainde and remaindes rents and profits of and singular the said premises above mentioned and of every part and parcel thereof with the appertenances, and also all the right title, intrest, clame and demand whatsoever as well in law as in equity of them, the said Matthew Garrett and Mary his wife, of in and to all and singular the premises abovementioned and of in and to every part and parcel thereof with appeurtenances to the same belonging to have and to hold all and singular the before granted premises and every part and parcel thereof with the appurtenances unto the only proper use and behoof of him the said Charles Downes his heirs and assigns forever according to the true intent and meaning of these presents and also that he the said Charles Downes his heirs and assigns shall and may at all times forever hereafter peaceably and quietly have hold, use, occupy, possess and enjoy all and singular the said Lands and premises abovementioned with the appurtenances without the let trouble, hindrance, molestation, interruption or denial of them ,the said Matthew Garrett and Mary his wife their heirs and assigns, and of and from all and every other person or persons claiming or to Clame by from or under them eighther (either) of them and of and from all and every other person or persons,whatsoever, and that freed andmdischarged or otherwise well and sufficancy and kept harmless and indemnify of and from all former and other bargains, sails (sales), gifts, grants, leases, mortgages, ___tures, dowers, recognisances, extents, judgements, executions, rents and arrages of rents and of and from all other charges, estates titles and incumberances, whatsoever; and further that said Matthew Garrett and Mary his wife doth for themselves their heirs and assigns covenant, grant and agree to and with the said Charles Downes his heirs and assigns and to and with every of them by these presents to save, defend and keep harmless the said Charles Downes his Heirs and assigns agains all manner of persons, whatsoever, shall and will warrant and forever defend in the peaceable possession of the above mentioned premises and further that he the said Matthew Garrett and Mary his wife or Eighther (either) of them shall and will from time to time, and at all times hereafter, upon the reasonable request and at the proper cost and charge of him, the said Charles Downes his heirs and assigns, make do and execute or cause to be made done and executed all such further lawfull and reasonable acts, devises and conveyances in the Law whatsoever for the further b___ and more perfect granting and conveying all and singular the Premises above mentioned unto the said Charles Downes his Heirs and assigns to the only proper use of him the said Charles Downes his heirs and assigns as by the said Charles Downes his heirs or assigns or his or their council learned in the law shall reasonably advise, devise or require In testamony whereof, the said Matthew Garret and Mary his wife have hereunto set their hand and affixed their seales the day and yeare above written.
