Downes III This Indenture made this fourteenth day of July in the year of Our Lord one thousand eight hundred and forty five between Ezekiel C. Hall and Sarah his wife, Lewis B. Engles and Ann Maria his wife formerly Ann Maria Hall, and Sarah Metts widow and relict of John Hall formerly of Queen Ann County State of Maryland all of the State of Pennsylvania, of the one part and Vachel Downs of Queen Ann County State of Maryland aforesaid of the other part, witnesseth that the said Ezekiel C. Hall and Sarah his wife, Lewis B. Engels and Ann Maria his wife, and Sarah Betts for and in consideration of the sum of Three Hundred and thirty three Dollars Current money of the State of Maryland to them in hand paid by the said Vachel Downs before the execution of this Indenture, the receipt whereof the said Ezekiel C. Hall and Sarah his wife, Lewis B. Engles and Ann Maria his wife and Sarah Metts, do hereby acknowledge and from the same and every part and parcel thereof do hereby forever exonerate acquit, and discharge the said Vachel Downs his heirs executors administrators and assigns, have given, granted, bargained, sold, aliened, released, enseoffed, conveyed and confirmed, and by these presents do give, grant, bargain, sell alien, release enseoff, convey and confirm unto the said Vachel Downs his heirs and assigns forever, All their right, title, interest, and estate of in and to Two undivided third parts of all that tract or parcel of land situate and lying in Queen Ann County aforesaid, now in the tenancy of the said Vachel Downs, near Halls Cross Roads, containing about two hundred and twenty six acres of land more or less, adjoining the lands of William Hall’s heirs, Hawkins Downs’ heirs, and the lands of Richard C. Downs, and which said tract of land is known by the name of Hog Harbour, Faulkners Hope, and Welsh Pool, and the reversion and reversions, remainder and remainders, rents, issues and profits thereof, and all and singular the right, title, interest and estate, either in law or equity of the said Eze3kiel C. Hall and Sarah his wife, Lewis B. Engles and Ann Maria his wife, and Sarah Metts, therein or thereto, together with all and singular the buildings, enclosures, improvements, benefits, advantages, easements and emoluments to the same hereby granted lands and premises belonging, or in any manner appertaining, to have and to hold all and singular the hereby granted undivided two thirds part of the said lands and premises, and every part and parcel thereof, with their assigns forever, to his and their whole and sole benefit, use and behoof and to and for no other use, intent or purpose whatever, and the said Ezekiel C. Hall and Sarah his wife, Lewis B. Engles and Ann Maria his wife and Sarah Metts, do for themselves their heirs, executors and administrators, covenant, grant, promise and agree to and with the said Vachel Downs his heirs, executors, administrators, and assigns, and each and every of them by these presents, that they the said Ezekiel C. Hall and Sarah his wife, Lewis B. Engles and Ann Maria his wife, and Sarah Metts their heirs executors, administrators and each and every of them the aforesaid lands and premises (hereby granted, or intended to be granted by the names aforesaid or by whatever name of names it may be called and every part thereof unto the said Vachel Downs his heirs, and assigns, each and every of them, against the claim and claims of the said Ezekiel Hall and Sarah his wife, Lewis B. Engles and Ann Maria his wife, and Sarah Metts, their heirs, and assigns shall and will warrant and forever defend by these presents, and further, that the said Ezekiel C. Hall and Sarah his wife, Lewis B. Engles, Ann Maria his wife, and Sarah Metts, their heirs and assigns and each and every of them shall and will at all time hereafter, at the reasonable request, and at the proper costs and charges of the said Vachel Downs his heirs or assigns, do make, execute and acknowledge all and every such further act or acts, conveyance or conveyances, assurance or assurances in the law, with warranty aforesaid for the further and better assuring and confirming the hereby granted, or intended to be granted lands and premises, and every part thereof, unto the said Vachel Downs his heirs and assigns forever as the said Vachel Downs his heirs or assigns or either of them, shall devise and require. In Testimony whereof the said Ezekiel C. Hall and Sarah his wife, Lewis B. Engles Sarah Metz Be it known that on the Fourteenth day of July Anno Domini 1845 Before me the subscribers one of the Commissioner of the State of Maryland duly appointed by the Governor and confirmed by the Senate thereof to take the acknowledgment and proof of deeds mortgages in the State of Pennsylvania to be used and recorded in the State of Maryland came Ezekiel C. Hall and Sarah his wife, Lewis B. Engles and Ann Maria his wife and Sarah Metts, who I am satisfied by good and sufficient oral testimony received by me under oath on the Grantors mentioned in the foregoing Indenture and to whom the full contents of the same were first made known by me and they did thereupon acknowledge that did execute sign seal and devise the same as and for them and each of their voluntary act and deed and the said Sarah Hall and Ann Maria Engles being both of full age in private examination separate and apart from their husbands did acknowledge before me that they did execute sign seal and deliver the same as and for their voluntary act and deed fully and without any fear threats or compulsion of their said husbands and without any undue influence whatever.
