All Rights Reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/md/mdfiles.htm ********************************************************* VINSON BAXTER Will of Vinson Baxter from Register of Wills, Queen Anne's County, Centreville, Maryland 1831, Liber TCE Folio No 1 page 418 In the name of God, Amen, I Vinson Baker of Queen Ann's County in the State of Maryland being sick and weak in body but of sound disposing mind memory and understanding considering the certainty of death and the uncertainty of the time thereof and being desirous to settle my wordly affairs and thereby be the better prepared to leave this world when it shall please God to call me hence do therefore make and publish this my last Will & Testament in manner and form following , that is to say... First and principally I commit my soul into the hands of Almighty God & my body to the earth to be buried at the discretion of my Executor hereinafter named and after my debt and funeral charges are paid I devise and bequeath as follows. Item. I give and bequeath unto my son George Baxter the farm on which he now resides cald (called) and known by the name of Suffolk or by what soever name it may be cald (called) to him and his lawful begotten heirs forever and in case of the ___ of my son George Baxter without lawful heirs as afs (aforesaid) it is my will & desire that the afs (aforesaid) farm shall go to my son Samuel Baxter to him and his lawful begotten heirs forever. Item. I give and bequeath unto my son William Baxter the farm that I purchased of John Atkinson formerly the property of James Herington to him & his lawful begotten heirs forever and in case of the death of my son William Baxter without lawful begotten heirs of the body, it is my will & desire that the aforesaid tract of land shall go to my son Samuel Baxter to him and his lawful begotten heirs of the body forever. Item. I give and bequeath unto my daughter Mary Downes my negro Harriet; to serve till thirty five years of age - my negro woman Deala to serve till thirty five years of age - my negro man Sam to serve till forty years of age - my negro woman _____ to serve till thirty five years of age, to her and her lawful heirs. Item. I give and bequeath unto my son George Baxter my negro man Jim to serve till forty years of age - my negro woman Mary to serve till thirty five years of age - my negro woman July to serve till thirty five years of age. Item. I give and bequeath unto my son William Baxter my negro boy Perry to serve till forty years of age - my negro girl Mahala to serve till thirty five years of age - my negro boy Elbert to serve till forty years of age. Item. I give and bequeath unto my son Samuel Baxter my negro boy George to serve till forty years of age - my negro girl Emaline to serve till thirty five years of age - my negro girl Charlot to serve till thirty five years of age. Item. It is my will and desire that my negro girl Hester be free at my deth (death). Item. It is my will & desire that the profits arising or may arise from my uncle Mark Bentons Estate be equally divided between my four children, to wit, George Baxter, Mary Downes, William Baxter & Samuel Baxter to them and their lawful begotten heirs of the body forever. Item. I give and bequeath unto my son William Baxter one Bay mare cald (called) ____ heretofore claimed by him. Item. I give and bequeath unto my son Samuel Baxter one horse worth by valuation $40.00 to be paid to him by my Executors hereinafter named. Item. I give and bequeath unto my three sons George Baxter, William Baxter and Samuel Baxter the balance of my estate both real & personal after the outstanding debts & my concerns either in my name or that of my son George Baxter is cloased (closed) & paid. And lastly I do hereby constitute and appoint my son George Baxter to be sole Executor of this my last Will and Testament revoking and annulling all former wills by me heretofore made ratifying and confirming this & none other to be my last Will and Testament. In Testimony whereof I have hereunto set my hand and affixed my seal this 13th day of July in the year of Our Lord One thousand eighteen hundred and thirty one. Connolly Queen Anns County September 5, 1831 Then came George Baxter the within named Executor and made oath on the Holy Evangely of Almighty God that the within Instrument of writing is the true & whole last Will and Testament of Vinson Baxter late of Queen Anns County dec'd that has come to his hands or possession and that he does not know of any other. Tho. C. Earle Reg Wills for Queen Anns County Queen Anns County September 5, 1831 Then came Henry Jump, Greenbary Knotts, and John W. Connolly the three subscribing witnesses to the within will and severally made oath on the Holy Evangely of Almighty God that they did see Vinson /Baxter the Testator therein named make his mark thereto & seal the same that they heard him publish pronounce and declare the same to be his last Will and Testament that at the time of his so doing he was to the best of their apprehensions of sound and disposing mind memory and understanding and that they subscribed their respective names as witnesses to the said will in the presence and at the request of the Testator and in the presence of each other: and the said Henry Jump further deposed and said that the several erasures and interlineations appearing on the face of the said will were all made previous to the execution thereof, Viz the word "lawful" interlined between the 19 & 20 lines 1st page, the word "cal" fourth fifth erased from the 5 line 2d page, the word "girl" interlined between the 28 & 29 lines 2 page, the words "I give" erased from the 29th line of 2d page, the 11, 12 & 13th lines erased from the 3d page & the figures "1831" erased from the 24th line 3d page: this deponent likewise says that the will was executed on the 13th day of July 1831.
