I tried not to take license with what I was reading, and preferred to leave blank those words I could not read.) +++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++ In the name of God Amen, I Hynson Downes of Queen Anne's County State of Maryland being weak in body but of sound and desposing mind and memory considering the certainty of death and the uncertainty of the time there of do therefore make and publish this my last will and testament in manner and form following that is to say. First I commit my soul into the hands of almighty God and my body to be decently buried at the descretion of my Executor herein after named and after my Just debts are paid. I devise and bequeath as follows. Item. I give and bequeath to my wife Mary Downes one third part of all my Estate real and personal during her natural life and no longer and that __ ____ no ___ of then ____ or said estate. Item. I give and bequeath unto my son Samuel Downes all my tracts of land lying and being in the _____ ( _ount_a___, countyseat?) cal'd [called] Shoreditch _____ ? (this ? is in the document) and part of a tract called "Acaddia" contain fifty acres more or less to him and his heirs lawfully begotten of his body and if he should die without heirs I give and bequeath to the above mentioned tracts of lands to my son Philemon Downes and his heirs forever. Item. I give and bequeath to my son Philemon Downes the sum of forty pounds to be paid unto him by my Executor to be hereafter named in anuel (annual) payments that is to say three pounds six schillings and eight pence per years untill untill (repeated in original document) the above forty pounds is discharged or in case my widow should die before the forty pounds is paid, in that case his is to be paid five pounds per year untill he receives the aforesaid sum of fourty pounds year. Item. I give and bequeath unto my daugher Ann Downes the sum of fourty pounds to be paid unto her by my Executor in anual payments that is when she arrives at the age of sixteen years. She is to receive three pounds six schllings and eight pence per year ___ ___ my widow should die before she recieves the above sum in that case she is to recieve five pounds a year untill the fourty pounds is paid. Item. My will is that my personal property after my wife's thirds is taken out be equally divided among my three children Samuel Downes, Philemon Downes, Ann Downes. And of this my last will and testament I do hereby appoint my son Samuel Downes my Executor, revoking and annulling all former wills by me heretofore made. In testimony whereof I have hereinto set my hand and affixed my seal this twenty second day of March Eighteen Hundred and four. Signed and published and declared in the prescence --- (of?) October 30th 1804 Then came Samuel Downes and made oath on the holy Evangels of Almighty God that the foregoing is the true and whole last will and testament of Hynson Downes of Queen Annes County deceased. October 30th 1804 Then came Philemon Green and made oath on the holy Evangels of almighty God that he did see the testator herein named sign and seal this will that he heard him publish pronounce and declare the same to be his last will and testament that at the time of his so doing he was to the best of his apprehensions of sound and disposing mind memory and understanding that he subscribed his ___ and ___ (name and seal?)
