State of Maryland, do make and publish this my last will and testament thereby revoking and making void all my former wills by me at any other time heretofore made, and first I direct that my body to be decently interred and as to suck worldly estate as it has that pleased God to interest me with. I dispose of the same as follows; First I direct that all my debts and funeral expenses be paid as soon after my decease as possible out of the first moneys that shall come unto the hands of my executor from any portion of my estate, also I give to me daughter Jane E. Wright my servants,Pere,Bill,Fred and Arvilda and her income to score till they are thirty-eight years old. Then to be free, I also give to me grandson John Gardner, my servant Benjamin to serve tell he is thirty-eight years old. Then to be free. I also give to my grandson Samuel Gardner my servant James to serve till he is thirty-eight years old, then to be free. I also give to my other grandson Theodore L. Gardner my servant Thomas to serve till he is thirty-eight years old, then to be free. I also give my servant Ian Wilson to my three grandchildren, John , Samuel and Theodore Gardner to serve till he is thirty eight years old, then to be free. Also will my servant women Mariah free at my death provided she remains with and takes care of my grandchildren. I also give to my three grandchildren John Gardner, Samuel Gardner and Theodore Gardner the whole of my real estate, to my daughter Jane I give my carriage, to my grandchildren,John,Samuel and Theodore I give all my houses, one half of my shop. I also give to my three grandchildren the other half of my sheep. I give to my daughter Jane my team of __and cart or carts. I give to my three grandchildren the balance of my cattle. I direct to be equally divided between my daughter Jane and my three Grandchildren, my hogs, pork or bacon and lard. I also give to my three grandchildren my wheat,fan,plough and all other kinds of farming implements and plough gear. I also give to my three grandchildren, to my daughter Jane I give my high post bed, my bureaus, big wheel and large rocking chair. The balance of my furniture, kitchen and household and all other unnamed property I give to my three grandchildren, John Samuel and Theodore Gardner. I also will that Susan Gardner, the wife of my deceased son, shall have a home in the house upon the said real estate with her children and they have the income arising from said real estate as well as the income that may arise from the servants. That I have given to her children, John , Samuel and Theodore Gardner.for their servants benefit and support so long as Susan Gardner remains single at which time she only is to be deprived of such named advantages. I also will that my daughter Jane shall have a home in the house upon my real estate during her natural life. And I also will that my real estate shall never be sold out of the entire possession of one or more of my grandchildren. Or as many of them as is necessary for the cultivation of said real estate also to kept on said real estate for that purpose. I also direct that my executor shall pay the expenses of an administrator upon my estate out of the money I may leave or have due me and if there be none, then to pay such expenses equally between herself and my three grandchildren out of the income that may arise from the property that I leave after my descease.and I do hereby make and ordain my dutiful daughter Jane E Wright, executrix of this my last will and testament and guardian to my three grandchildren John Gardner Samuel Gardner and Theodore Gardner. In witness whereof I. Frances Gardner, the testator have to there will set my hand and seal this twelfth day of January in the year of our lord one thousand eight hundred and fifty-seven. Signed sealed and delivered in the presence of us, who have subscribed in the presences of each other W.W.K.Goodhand Frances(her X mark) Gardner(seal) Luther W Bryan William B Goodhand Queen Anne's Co.,then came W.W.K.Goodhand Aug 7th 1860,Luther W Bryan and William Goodhand the subscribing witnesses to the foregoing will and made oath on the holy evangely of Almighty God that they did see Frances Gardner testator there named make her mark to the forgoing will that they heard her publish, pronounce and declare the same to be her last will and testament that at the time of so doing she was to the best of their apprehension of sound and disposing mind,memory and understanding that she subscribed their names as witness to the said will in the presence of the testator at her request
