(Wills, Original) Box 6, Folder 51 - 2-3-4-23 Re. Q. A. Will 1752 Maryland - In the name of God Amen. I David Herinton of Queen Anne's County in the Province of aforesaid knowing it is appointed for all men once to die do ordain this my last will and testament in manner and form following. Imprimis. I give and bequeath to my loving wife and my son Nathan my now Dwelling plantation called Beavour Dam's Additon to them and their heirs forever. Item. I give and bequeath to my son George Herrington a tract of land called Joneses Forest to him and his heirs and assigns forever. Item. I give and bequeath to my son John Herrinton a tract of land called Buck's Bay to him and his heirs and assigns forever. Item. I give and bequeath to my son James Herinton a tract of land called Beavour Dam to him and his heirs and assigns forever. Item. I give and bequeath to my son Gideon Herrington a tract of land called Herrinton's Desire to him and his heirs and assigns forever. Item. I give and bequeath to my daughter Ann Long one hundred acres of land called Hopewell to her and her heirs forever. Item. I give and bequeath to my wife Rebeca Herinton and children, Viz. George, John, James, Nathaniel, Nathan, Gideon and Ann after my just debts are paid all the rest of my estate to be equally divided amongst them and lastly I do hereby appoint my wife and my son George Herinton Executors of this my last will and testament utterly revoking all the other wills by me before made. In witness whereof I have hereunto set my hand and seal this 22nd Day of April Anno Dom 1752. Signed Sealed Pronounced and delivered to be my last will and testament in the presents of Jno. Newman, Jno. (his mark) Furbus, Marth (her mark) Cohee, David (his mark) Herinton. Queen Anne's County The 21st Oct. 1752 } John Newman, John Furbush and Martha Cohee the subscribing Witnesses to the aforegoing Will being duly and solemnly sworn on the Holy Evangels of Almighty God do depose & say That they saw the Testator David Herrington sign the same Will and heard him publish and declare it to be his last Will and Testamont. That at the time of his so doing he was to the best of their Apprehenson of sound and disposing Mind and Memory and that they did subscribe their respective names and marks as Witnesses to the said Will in the Prescence of the said testator and at his Request Which Oath was taken by the said Witnesses in the Presance of George Herrington Heir at Law to the Testator what same George Herrington did not object to the probat of the said Will. Sworn before me Wm. Tilghman Dep. Comry (?) of Queen Anne's County The 21st Oct. 1752 Then came Rebecca Herrington Widow of the within Testator David Herrington and declared that she did accept of the Devise of Land made her by the within Will in Lieu of the one third part of her said Husband's Real Estate, but that it was her Choice to have the one third part of his personal Estate as the Law for her provides.
