The tenth day of April in the year of our Lord God One thousand Six hundred ninety and One. I EDMUND BEAUCHAMP Mercer of London and at the writing hereof County Clerke of Somerset in the Province of Maryland being Sick in body but of good & perfect memory thanks be unto Allmighty God, Calling to remembrance the uncertaine Estate of this transitory life, And that all flesh must yield unto death when it shall please God to call. Doe make, Constitute Ordaine & declare this my last will and Testament in manner and forme following revoaking and anulling by these presents all and every Testament & Testaments Will and Wills heretofore by me made and declared, either by word or writing, and this to be taken Only for my last Will and Testament and none other And first being penitent and Sory from the bottom of my heart for my Sins past most humbly desire forgiveness of the Same. I give and Comitt my Soul unto Allmighty God my Saviour and Redeemer in whome and by the meritts of Jesus Christ. I trust and believe assuredly to be Saved and to have and to have full remission and forgiveness of all my Sins & that my Soule with my body at the day of resurrection shall rise again with joy, and through the merits of Christs death and passion posess and inherit the Kingdome of heaven prepared for his Elect and Chosen And my body to be buried decently at the discretion of my Execcutor. And now for the Setling my temporal Estate, and Such goods and debts as it -- hath pleased God farr above my deserts to bestow upon me. I doe give and dispose the same in manner and forme following (That is to say) first I will that all those debts and duties as I owe in Right or Conscience to any manner of person or persons, whatsoever shall be well and truly Contented and paid or Ordained to be paid within Convenient time after my decease by my Execcutor hereafter named Imprimus I give and bequeath unto my wife SARAH BEAUCHAMP my best ffeather bed and appurtenances thereunto belonging viz) Rugg Blanketts Sheets boulster Pillowes Curtains & vallance, my Mare Mount with her future increase both male and female, two Cows with Calfe or Calves by their Sides. One Table three Chairs, two Iron potts, One frying pan the Land where she now lives, bounded from the first bounder of my Sonn Thomas Land to the bounds of my Sonn JOHN BEAUCHAMPs Land to have and to hold the Same dureing her widdowhood, Also I give and bequeath to her twelve pence in money Sterling to be paid her by my Execcutor hereafter named in Convenient time. Item I give and bequeath unto my Sonn THOMAS BEAUCHAMP my horse Dick my Gun and wearing apparel. and all my fees due arrears as Concerning the Clerks place before mr John: West and my Selfe were Concerned as partners togeather, as also I give and bequeath unto my Said Sonn Thomas Beauchamp One Cow and One ewe with their increase both male and female Item I give and bequeath unto my Sonn EDMOND BEAUCHAMP that part of my devident of Land Called Contention begining at a Corner tree of my Sonn Thomas by Conveyance made Over to him by my Self and wife, by the horse road by the lower dam & So up the Eastmost Side of the dam untill it Come to the uppermost dam then ninety pearches to a marked tree and from thence to (another) Corner tree of my Sonn THOMAS Land on the westermost Side of the horse road, and then along the horse road to the Corner tree of my Sonn Thomas Beauchamp land the first bounder, also I give and bequeath unto him my son EDMUND One Cow with Calve or Calfe by her Side, also the first Colt my Mare Mount bringeth wher male or female p. 116 With their increase. The land qt. by Computation fifty Acres, also to be paid him by my Execcutor at twenty - years of age One thousand pounds of tobacco, then to be free and at his owne dispose, to have and to hold the said Land to him the said Edmund and to his Heirs for ever as also One Ewe with her increase. Item I give and bequeath unto my Sonn JOHN BEAUCHAMP that lower part of my land called Contention qt. fifty Acres more or less, begining at a marked Stake with eight Notches two of a Side Standing a litle below my Orchard at the mouth of a Branch runing downe and into the main River of Animessex and runing downe the Said River with Severall angles untill it comes to a Creek Called the Northeast branch thence up the sd branch or Creek with Severall angles till it intersects the line by the Creek side of Robert Catlin, and thence along the line of Robert: Catlin fifty pearches to a marked tree, and after that fifty pearches in the woods is runne Out with a Streight line to the first bounder the marked Stake with eight Notches. To have and to hold the Said land to him the sd JOHN BEAUCHAMP his Heirs and Assigns for ever; I give and bequeath unto my sd Sonn JOHN. One Cow with Calfe or Calfe by her Side to be delivered the next May following with her increase both male and female after my decease, also two Sow Shoats with their future increase, and the first Colt my Mare Motle shall bring after my decease whether Male or female. And also two thousand pounds of tobacco to be paid him by my Execcutor at twenty years of Age then to be free also my Hamock at J: W. and One Ewe with her increase. Item I give and Bequeath unto my daughter ALICE BEAUCHAMP my ffeather bed pillow, One paire of blanketts and my bible marked with 2:letters J D . at the Clerks Office, One Cow & Calfe or Calfe by her Side, Two Sow shoats with their increase for ever, and my Mare Motle with her increase for ever. (Excepted as before excepted) as also I give and bequeath further unto my said daughter Alice Beauchamp, Two thousand pounds of tobacco to be paid her the next Cropp following after her day of marriage as also one Ewe with her increase. Item I bequeath unto my Sonn DOGET BEAUCHAMP One Cow and Calfe and her increase for ever, the male excepted to my Sonn Thomas untill eighteen years of age, then both male and female and to enjoy as his propper goods for ever with five hundred pounds of tobacco to be paid him by my Execcutor at the age of twenty years, as also One ewe with her increase . - Item I give and bequeath unto my Sonn EDWARD BEAUCHAMP, One Cow and Calf and their increase for ever the male excepted as before untill eighteen years of age then both male and female, and to enjoy as his propper goods for ever, with five hundred pounds of tobacco to be paid him by my Execcutor at the age of twenty years, and One Ewe with her increase Item I give and bequeath unto my Sonn ROBERT BEAUCHAMP One Cow Calfe, the said Cow Calfe to be paid him and delivered to his use at the age of ten years and if it dies to deliver him another until Such time its a Cow and hath a Cowe Calve by her side the male increase as before to my Sonn Thomas untill eighteen years of age then the sd Robert to enjoy both male & female as his propper goods for ever, & I also give him four hundred pounds of tobacco to be paid him by my Execcutor at twenty years of age, and One Ewe with her increase. Item I give & bequeath unto PATIENCE BEAUCHAMP twelve pence in money to be paid her at the day of Marriage. It is my will and desire that all the rest of my moveables be equally devided & distributed unto my Sonn THOMAS BEAUCHAMP Sonn EDMUND BEAUCHAMP Sonn JOHN BEAUCHAMP Daughter ALICE BEAUCHAMP, Sonn DOGET BEAUCHAMP Sonn EDWARD BEAUCHAMP & Sonn ROBERT BEAUCHAMP by equall proportions, as also after debts Legacies and funerall Charges paid by my Execcutor hereafter named, all debts due to me for fees to be understood the One halfe that was earned between mr John West my Deputy and my Selfe, may be equally devided amongst my Children last named. And to be paid to my Execcutor hereafter named, hereby requesting mr. ffrancis: Jenckins. George: Layfield Esqr. and mr John West p. 117 ffor ffees in trust to See this my last will & Testatment executed to each for A remembrance I give & bequeath Tenn shillings a piece or the value thereof. And lastly I doe hereby Ordaine and appoint my Loving Sonn Thomas Beauchamp Sole Execcutor of this my last will and Testament. William. & Mary by the grace of God of England Scotland ffrance and Ireland King & Queen defenders of the faith &c To THOMAS BEAUCHAMP of Somerset County Greeting: Whereas EDMUND BEAUCHAMP of the sd County deceased Gent. we doe therefore grant unto you the sd THOMAS BEAUCHAMP Full power and authority to Administer all and Singular the goods Chattels and Credits of the said deceased, and to demand colect and leavy, and in legall manner require and receive all and all manner of debt and debts due and Owing to the said deceased, and well and faithfully to dispose the same. And out of the goods Chattels and Credits of the deceased, which have may or shall come to your hands or posession well and truly to pay the debts due by the said deceased So farr forth as the Same will thereunto extend and the law will charge you according to the true value of the Sum thereof. You having first taken your Oath well and truly to Admr the Same, and to make or cause to be made a true and perfect Inventory of all and Singular the goods Chattels and Credits of the said deceased, which have may or shall come to your hands posession or knowledge (Appraised in money) And a true and just accompt of & upon yr Administracon therein, And to exhibit both into our County Court where wills are proved. Touching which Inventory you are prSently assigned to performe or at furthest at or before the second tuesday in June next after the date hereof And an accompt within twelve months from the date of these presents. And lastly we doe hereby Constitute Ordaine and appoint you the said Thomas Beauchamp Adminstrator of all and Singular the goods Chattels and Credits of the sd deceased Signed pr Order. of Court this twelvth day of November in the fourth year of their Said Maties Reign Anno Domini One thousand Six hundred ninety and One. pr Jno. West. Clr Cur Somerset County in Maryland . We doe hereby impower you mr Nathaniel: Horsey and mr George Lane to Appraise the goods and Chattels of mr EDMUND BEAUCHAMP decd. You having first taken your Oaths before mr Stephen: Horsey One of their Maties Justices of the peace for this County. And you are to Certifie the true value of the said goods and Chattels (Appraised in money) under your hands and Seals into our County Court to be holden the Second tuesday in June at the furthest after the date hereof. This pr Order of Court dated ye 12th. day of November in the 4th. year of their Maties Reign William and Mary King & Queen Over England &c Anno Domini One thousand Six hundred ninety and One. Teste. West Clr Cur p. 118 Know all men by these prSents that we THOMAS BEAUCHAMP Miles: Gray and Mearcy ffountaine of the County of Somerset and Province of Maryland Gentm doe acknoweldge and Confess our Selves to owe and are indebted unto their Maties King William and Queen Mary Over England &ca for the use of the Orphts of mr EDMUND BEAUCHAMP decd, the just Sum of Two hundred pounds Sterling money of England, which we promise to pay to their Maties or to their Successors for the uses aforesd, and for ye true prformance of the Same to be well and truly paid we bind us and each of us, our Heirs, Execcutors and Admrs joyntly and Severally in and for the whole. In Testimony whereof we have hereunto Sett our hands and Seals -- this first day of ffebruary in the fourth year of their Maties Reign. Anno Domini 1691 -- The Condition of the abovesd Obligation is Such that if the above bound THOMAS BEAUCHAMP doe will and truly Observe, and Satisfie all and every of the will of EDMUND BEAUCHAMP decd, which Said Will beareth date the tenth day of April Anno: 1691. As well as to pay all and every the debts of ye Said deceased, upon Order had and Obtained from their Maties Justices of the Peace in Court Sitting As also to observe the Clause and Clauses, in the said letters of Administration, And to make no waste Sale or destruction, in, of, or upon the real Estates of Orphants viz, dwelling houses, Lands, woods Orchards and ffences. Observing that Law entituled, An Act for preservation of Orphants real Estates And lastly to keep harmless and indempnified the Justices of the Peace of the sd County for Probat of Wills and granting of Administrations, and all other the Officers therein Concerned. That then this present Obligation to be void and of none effect. Otherwayes to be and remaine in full power force and vertue.
