I Thomas Cox Senr of Somerset County being weak of body but of perfect mind & memory thanks be to God for the same do ordain constitute & appoint this my last will and testament in manner and form following viz first and principally I bequeath my soul to almighty God who gave it me in certain hope of a blessed Resurrection through my Lord and Saviour Jesus Christ and as for such worldly goods and estate as it hath been pleased God to bless me with I leave and give as followith first that all my just debts be paid & in due time. Item I leave and bequeath unto my son Thomas Cox all that part of my land lying on the westemost side of a line marked Tree now sold to Mr. Ebenezer Handy taken out of two pattents called Alderbury and Milton the said land beginning at a marked pine standing on the bank side of ye branch of Rockawalkin thence by a line of marked Trees to the cart road ca?ing to the landing and from the said pine to the first bounder of a parcell of land called Plumpton Salt Ash being a white oake as by pattent doth appear & thence by the aforsd branch to the pine above the old wading place. I likewise give my said son Thomas Cox Hill Cox & Thomas Cox my grandsons sixty acres of land out of my land called Plumpton Salt Ash viz beginning at the first bounder of the sd land & running down the brandch thirty poles thence into the woods parallel with the last line to ye back of ye sd land all the afsd land. I give to my said son Thomas Cox & Hill Cox & Thomas Cox my grandsons forever. Item I give & bequeath to my two grandchildren Archibald and Sarah Ann Smith two hundred acres of land taken out of Plumptons Salt Ash next adjoining to the land I left my son son (sic) Thomas out of the sd pattent running down the main branch of Rockawalkin till a parrellel line to the head in the woods will make up the quantity of two hundred acres to them and their heirs for ever to be equally divided between them in quantity and quality the sd land is to begin where my son Thomases thirty pole from the first bounder of the sd pattent called Saltash leaves off. Item I give & bequeath unto my daughter Liddie all that tract or parcell of land called Alderman Bury containing one hundred & seventy eight acres according to pattent also I do give and bequeath to my sd daughter Liddia all the remaining part of the said tract of land called Wilton not containing within the lines of land sould to Mr. Ebenezer Handy all which two parcells of land I give to my said daughter Liddia and the heirs of her body lwefully begotten for ever. Item I give my sd daughter Liddia one featherbed and two ruggs to her and her heirs forever. Item I give and bequeath unto my grandson John Stevens all that tract of land I have lying in Broad Creek neck containing one hundred & seventeen acres according to pattent to him and his heirs forever. I give and bequeath unto my grandson John Stevens all that tract of land I have lying in Broad Creek neck containing one hundred & seventeen acres according to pattent to him & his heirs forever. Item that my Executrix upon proviso that James Lawly or his heirs should produce a bond from me for the quantity of one hundred acres of land that my executix shall find him one hundred acres of land and make it over tothe sd James Lawly and his heirs forever. Item I give to John Davis my Great Bible to him and his heirs. Item I give to my daughter Sarah Turpin my leather trunk and one shilling sterling in full of her portion. Item I give my daughter Jane Disharoone one shilling sterling in full of her portion. Item I give to my daughter Margratte one shilling sterling in full of her portion. Item I give unto my son John Davis one shilling sterling in full of his portion. Item I give unto my son Thomas Cox the third of my debts due to me from Mr. Ebenezer Handy. Item I give unto Rachell Walton one spinning whell. Item I give unto Rachell Waltons two children each of them a cow calf a piece as also I pay what she is indebted to the Shreve. As also I give Wm Hearn a priveledge of my spoon molds during his life time. And lastly I do hereby constitute and appoint my daughter Liddia the wife of Jeremiah Wright to be my whole and sole executrix of this my last will and testament giving the said executrix all the remainder of my estate both real and personal which is not already disposed of ehreby revoking all formes and other wills by me heretofore made. In witness hereod I have hereunto set my hand and seal this twentieth day of november Anno Dom 1724 the mark of Thomas T Cox Seal Sealed & delivered by the testator as and for his last will & testament in the presents of us who in his presents have set our hands as witnesses hereunto the mark of her the mark of Andrew A Rathbone Elizabeth E Walton Sarah S Right William Hearne mark January 13th 1724 came William Hearne & Sarah Right subscibing evedence to the within will who made oath upon the Holy Evangellist of Almighty God that they see the within named Thomas Cox the Testator signe & seal the within instrument as his last will and testament & that they heard him publish and declare the same so to be & that at the time of his so doing he was of sound disposing mind & memory to the best of thier knowledge. Sworn before me the day & year above written / John Tunetall Depty Comssr of Somr County 1st Apl 1730 came Andrew Rathbone one of the subscribing evedences to the within will and made oath on the holy evengels of Almighty God that he saw the within named Thomas Cox the testator sign & seal & heard him publish & declare the within instrument as his last will & testament & that at the time of his so doing he was to the best of this deponents knowledge & apprehension of sound and disposing mind & memory and that he the aforesaid Andrew Rathbone together with Elizabeth Walton Sarah Right & William Hearbe as witnesses subscribed the said will in the presense at the request of the said Testator.
