I Nicholas Fountain of Somerset County in the Province of Maryland, being in health of body and of good and perfect memory thanks be to god for the same, yet knowing the uncertainty of this present life and being desirous to leave things in order doo make this my last will and Testament in manner and form following. First and principally I commend my soul to God Almight my creator who gave it me, assuredly beleiving that I shall receive full and free pardon of all my sins and be saved by the previous death & merette of my Blessed Savious and Redeemer Jesus Christ, and my body to the Earth from whence it was taken to be buried after a decent and christian manner by my executrix hereafter named and as touching what worldly estate the lord in his mercy hath given it is my will that it be bestowed as is hereafter expressed. I leave and bequeath unto my son Mercy Fountain one hundred acres of land called New France, and after his decease to his son Wm Fountain, to him and his heirs forever. And this hundred acres of land shall stand in lieu and defray all debts that sd Mercy shall or may bring in against my any estate after my decease. I leave and bequeath unto my sons Nicholas and Stephen Fountain a tract of land called Fountains Lott lying and bounded as per Pattent will appeare containing three hundred acres of land to my sd sons Nicho. & Stephen & their heirs for ever to be equally divided between them, likewise I leave unto my sd sons Nicholas & Stephen a tract of land ajoining unto it called Normandy containing fifty acres of Land lying and bounded as per pattent will appear to be equally divided between my sd. Sons Nicho. & Stephen, to them and their heirs for ever. Also I leave unto my sd sons Nicholas & Stephen ten acres of land formerly alienate unto me by Capt. Henry Smith out of a tract of land called Peake to be equally divided between my sd sons to them and their heirs for ever, and if it please God that either of the sd boys die before they come to age, that then the other shall enjoy the sd tracts he and his heirs for ever, likewise I leave unto my sd sons Nicholas & Stephen a tract of land called Raimly Containing one hundred & fifty acres to be equally divided between my sd sons to them and their heirs for ever, likewise I leave unto my sd sons two heifer markt as followith, the left ear cropt with a nick in the under side, the right ear a poplar leaf with with a slitt in the ?ase the sd heifers which all their increase to the sd boys Nicho & Stephen and there heirs for ever. Likewise it’s my will that my sd sons be at age for themselves when sixteen years old. I leave unto my beloved wife Joanna Fountain my dwelling house and plantation during her widowhood and if after she marry it is my will that she be confined to a third part thereof, also I leave unto my sd wife a third part of all my other goods and moveables whatsoever, and the other two parts I leave to be equally divided between my sons Mercy, Nicholas & Stephen and my daughter Dennis Lane, to them and their heirs for ever. And I doe hereby constitute and appoint my beloved wife Joanna Fountain to be executrix of this my last will and testament disanulling and making void any other will or wills formerly by me made either word or writt and I appoint John and Stephen Horsey my boys God Fathers to be there overseers.
